1 Media Coverage on the Istanbul Convention Marceline Naudi elected member of GREVIO 19/05/ MaltaToday / Malta Head of Gender Studies Department at the University of Malta Marceline Naudi has been elected as a member of the Group of Experts on Action against Violence against Women and Domestic Violence The Malta Confederation of Women s Organisations (MCWO) has congratulated Marceline Naudi upon her election as a member of GREVIO, (the Group of Experts on Action against Violence against Women and Domestic Violence). In a press release the MCWO said that the election took place during the 1st meeting of the Committee of the Parties to the Istanbul Convention held in Strasbourg on Monday 4th May. Naudi, who is Head of the Department of Gender Studies at the University of Malta, has a long standing background in issues of gender equality and especially violence against women. She represented Malta at the Council of Europe ad Hoc Committee on Violence against women and Domestic violence (CAHVIO) which drafted the Istanbul Convention and she is a member of the Women s Study Group as well as a representative of the MCWO on the European Women s Lobby Observatory on Violence against Women. The Confederation is an umbrella organisation that represents 13 local member organisations. The MCWO is a full member of the Brussels based European Women s Lobby. 2 STRASBOURG - The Council of Europe (CoE) has announced the formation of a new initiative to combat gender-based violence, the Group of Experts on Action Against Violence against Women and Domestic Violence (GREVIO). GREVIO will monitor implementation of the CoE Convention on preventing and combating violence against women and domestic violence (Istanbul Convention), a treaty first opened for signature in Istanbul on May 11, In a speech made last Monday, during the first meeting of the Committee of the Parties to the Istanbul Convention, CoE Deputy Secretary General Gabriella Battaini-Dragoni praised the convention as "a treaty which clamps down on all types of abuse - from emotional torment, to stalking and harassment, to beatings and rape." "The real test - putting the Convention into force - comes now," she declared. The meeting of the Committee of the Parties was held in Strasbourg to adopt rules of procedure, elect a chair and vice-chairs to the committee, and elect the first ten members of GREVIO. GREVIO members will serve for four years as independent experts, developing evaluation reports of legislative and policy measures taken by countries that have ratified the Istanbul Convention. They may also initiate a special inquiry procedure in cases of "serious, massive, and persistent patterns of violence" covered by the convention. The newly elected GREVIO members, all female, represent 10 of the 18 countries who have ratified the Istanbul Convention. Poland was the last country to ratify it, becoming the 18th State Party to the convention on April 27, France, Italy, and Turkey are among the ratifying countries of the Istanbul Convention. Nineteen countries, including Germany, Switzerland, and Belgium, have signed the treaty but have yet to ratify it. GREVIO will meet for the first time in the autumn of Art. n

Si tratta di un incontro formativo dal titolo «Convenzione di Istanbul sulla prevenzione e la lotta contro la violenza domestica: siamo pronti?», è organizzato dal Centro Pari Opportunità della Valdelsa e dal Consiglio dell'ordine degli Avvocati di Siena e si svolgerà domani alle 15,30 nella sala Minore del Teatro Politeama. «Proseguiamo il percorso di crescita delle politiche di contrasto alla violenza di genere dice il presidente del Cpo Lucia Coccheri». Il primo agosto 2014 è entrata ufficialmente in vigore la Convenzione del Consiglio d'europa sulla prevenzione e la lotta contro la violenza nei confronti delle donne e la violenza domestica, la cosiddetta «Convenzione di Instanbul», che interviene specificamente nell'ambito della violenza domestica. La violence faite aux femmes sous surveillance 06/05/ L'Avenir / Belgique Si la violence conjugale n est plus au nombre des priorités policières en Belgique, le Conseil de l Europe a mis en place un nouveau groupe de suivi de dix membres qui veillera à l application de la convention d Istanbul, qui vise à mettre fin à 3

Kandidat za člana iz Crne Gore bio je i profesor Fakulteta političkih nauka iz Podgorice, Uglješa Janković. Prvih 15 država koje su ratifikovale Istanbulsku konvenciju, izabralo je, kako prenosi Pobjeda, deset nezavisnih eksperata kako bi formirali tijelo pod nazivom "Grupa eksperata za akciju protiv nasilja nad ženama i u porodici"(grevio). Države članice koje su ratifikovale Konvenciju SE za prevencijui borbu protiv nasilja nad ženama i u porodici (Istanbulska konvencija) formirale su odbor za izbor GREVIO članova i kako bi osigurale da se preporuke tog tijela poštuju. GREVIO će nadgledati aktivnosti vlada na primjeni Istanbulske 4

Baptisé le GREVIO, ce groupe d experts "indépendants" évaluera les mesures prises par les gouvernements pour mettre en œuvre ladite convention et produira des documents périodiques, basés sur les rapports émanant des Etats Parties de la convention ainsi que sur les informations fournies par des ONG et d autres membres de la société civile et pourra se rendre dans les pays en question pour recueillir des informations complémentaires. Entrée en vigueur en août 2014, la convention européenne relative à la prévention et la lutte contre la violence à l égard des femmes et la violence domestique, appelée aussi "Convention d Istanbul", a été ratifiée, jusqu à ce jour, par dix-huit Etats membres. El Grupo de Expertos sobre la Lucha contra la Violencia contra las Mujeres y contra la Violencia Doméstica (GREVIO), elegido por los quince países (de 47 miembros) que han ratificado el convenio, tendrá su primera reunión el próximo otoño, explicó el Consejo de 6

7 Europa en un comunicado. Su misión es evaluar las medidas tomadas por los gobiernos para aplicar ese texto y garantizar que las recomendaciones que establezca se cumplan. Se apoyará en los informes de los Estados, pero también en informaciones de organizaciones no gubernamentales y otros miembros de la sociedad civil. Además, tendrá competencia para visitar los países para hacerse una idea por sí mismo. "Es hora de ponerla a prueba, de garantizar la aplicación del convenio", señaló la secretaria general adjunta de la organización, Gabriella Battaini-Dragoni. El Gobierno nombra a la jueza Gemma Gallego responsable española de violencia de género en el Consejo de Europa 05/05/ Europa Press - El Mundo / Spain La jueza Gemma Gallego, designada vocal del Consejo General del Poder Judicial por el PP en 2008 y recientemente ascendida a magistrada de la Audiencia Provincial de Madrid, ha sido nombrada por el Gobierno como representante española ante el GREVIO, el grupo de expertos recién creado en el seno del Consejo de Europa para velar por la erradicación de la violencia de género en los Estados parte. Siendo magistrada en el Juzgado de Instrucción número 35 de Madrid anuló la imputación por falsedad que había dictado el juez de la Audiencia Nacional Baltasar Garzón sobre tres peritos que en un informe vincularon a ETA con el 11-M a partir de la detección de ácido bórico en unos registros. Absolvió a los peritos y sentó en el banquillo a varios mandos de policía científica que habían participado en el caso, aunque en 2008 fueron finalmente absueltos. Gallego, miembro de la Asociación Profesional de la Magistratura (conservadores) y recién llegada a la Audiencia Provincial, pasa ahora a formar parte de los diez miembros del GREVIO del Consejo de Europa que monitorizarán el cumplimiento del Convenio sobre prevención y lucha contra la violencia contra las mujeres y la violencia doméstica. La selección del GREVIO ha corrido a cargo de los primeros 15 países que ratificaron aquel gran acuerdo, conocido como la Convención de Estambul, constituyendo así el Comité de Partes que contemplaba 7

8 crear y que hasta ahora, no había visto la luz. Según explica el Consejo de Europa, la implicación de los propios Estados garantiza que las recomendaciones del Grupo sean tenidas en cuenta. El GREVIO monitorizará la situación en cada país a partir tanto de su información oficial como de la perspectiva que aporten las distintas ONG que trabajan en el área de lucha contra la violencia. A partir de estos datos elaborará exámenes periódicos y podrá emitir recomendaciones concretas para cada país. Su primera reunión tendrá lugar en otoño. "El auténtico examen --de la puesta en marcha de la Convención-- empieza ahora", apunta la secretaria General Adjunta del Consejo de Europa, Gabriella Battaini-Dragoni, para incidir en que el trabajo de los recién nombrados "será crucial". Heinisch-Hosek gratuliert Rosa Logar zur Wahl in ExpertInnengruppe des Europarats gegen Gewalt an Frauen 05/05/ APA - OTS / Austria In Österreich wird die Umsetzung der Istanbul-Konvention durch einen Nationalen Aktionsplan vorangetrieben Frauenministerin Gabriele Heinisch-Hosek gratuliert Rosa Logar zu ihrer gestrigen Wahl in die ExpertInnengruppe des Europarats zur Bekämpfung von Gewalt gegen Frauen und häuslicher Gewalt (GREVIO), die mit der Kontrolle der Umsetzung der Istanbul- Konvention betraut ist. "Rosa Logar kenne und schätze ich als engagierte Kämpferin im Einsatz für Frauenrechte und für ein gewaltfreies Leben. Sie hat ganz wesentlich an der Ausarbeitung der Istanbul-Konvention zur Bekämpfung von Gewalt an Frauen und häuslicher Gewalt mitgearbeitet und ich bin überzeugt, dass ihre Expertise und ihr Engagement eine wichtige Bereicherung sein wird", so Heinisch-Hosek. Am 1. August 2014 ist die Istanbul-Konvention in Kraft getreten. Österreich hat dieses wichtige Instrument als einer der ersten Staaten ratifiziert. Die Konvention anerkennt Gewalt gegen Frauen als strukturelle Gewalt, zu deren wirksamen Bekämpfung eine 8

9 gesellschaftliche und rechtliche Gleichstellung erwirkt werden muss. Ihr Geltungsbereich umfasst alle Formen der Gewalt gegen Frauen inklusive häuslicher Gewalt. Österreich hat die Konvention bereits weitgehend umgesetzt, sie bietet aber die Chance, Standards im Bereich Gewalt gegen Frauen international anzuheben und auch in Österreich die Maßnahmen zur Prävention von Gewalt und zum Schutz der Opfer weiter voran zu treiben. "Ich habe daher bereits 2013 eine interministerielle Arbeitsgruppe unter Vorsitz meines Ressorts mit der Ausarbeitung eines Nationalen Aktionsplans betraut, den die österreichische Bundesregierung im August des Vorjahres beschlossen hat. Mehr als 60 Maßnahmen werden 2014 bis 2016 gesetzt, sieben Ministerien - Justiz-, Innen-, Außen-, Sozial- Gesundheits- und Familienministerium, sowie mein Haus - arbeiten dabei, ganz im Sinne der Konvention, zusammen", so Heinisch-Hosek. Dışişleri Bakanlığı ndan yapılan açıklamada Türkiye nin Avrupa Konseyi Dönem Başkanlığı sırasında 2011 yılında İstanbul'da imzaya açılan Kadına Yönelik Şiddet ve Aile İçi Şiddetin Önlenmesi ve Bunlarla Mücadeleye Dair Avrupa Konseyi Sözleşmesi'nin, on ülkenin onay işlemlerini tamamlaması ardından, 1 Ağustos 2014 tarihinde yürürlüğe girdiği belirtildi. Açıklamada, Türkiye nin de, İstanbul Sözleşmesi olarak anılan Sözleşme'yi ilk imzalayan ve ilk onaylayan ülke olduğu belirtilirken şöyle denildi: İstanbul Sözleşmesi Taraf Devletler Komitesi'nin ilk toplantısı 4 Mayıs 2015 günü Strazburg'da yapılmıştır. Avrupa Konseyi Nezdindeki Daimi Temsilcimiz Büyükelçi Erdoğan İşcan ın oybirliğiyle başkanı seçildiği anılan Komite nin toplantısında, İstanbul Sözleşmesi'nin denetim organı olarak görev yapacak olan uzmanlar grubu GREVIO için seçimler gerçekleştirilmiş, adayımız Prof. Dr. Ayşe Feride Acar, 10 bağımsız uzmandan biri olarak GREVIO üyeliğine seçilmiştir. Bakanlık, açıklamasında ayrıca Türkiye, uluslararası insan hakları hukukunun geliştirilmesi ve etkin uygulanması konusunda, kurucu üyesi olduğu Avrupa Konseyi çerçevesinde de katkılarını sürdürmeye kararlıdır dedi. 9

10 Rada Európy vytvorila odbornú skupinu na presadzovanie Istanbulského dohovoru 06/05/ TASR / Slovakia Rada Európy (RE) dnes oznámila, že sa podarilo dosiahnuť dôležitý krok v snahe zabrániť násiliu páchanému na ženách. Rada Európy v pondelok (4.5) vymenovala novú, desaťčlennú monitorovaciu skupinu, ktorá bude presadzovať implementáciu takzvaného Istanbulského dohovoru. Dohovor Rady Európy o predchádzaní násiliu na ženách a domácemu násiliu a o boji proti nemu (Istanbulský dohovor) zatiaľ ratifikovalo 15 krajín 47-člennej paneurópskej organizácie. Predstavitelia týchto krajín vybrali v pondelok desať nezávislých odborníkov, ktorí vytvoria Skupinu expertov na boj proti násiliu na ženách a domácemu násiliu (GREVIO). Členské štáty, ktoré už ratifikovali Istanbulský dohovor, vytvorili takzvaný Výbor zmluvných strán, ktorého úlohou bolo zvoliť členov GREVIO a zabezpečiť, aby budúce odporúčania skupiny GREVIO boli plnené. Úlohou GREVIO bude sledovať opatrenia prijaté vládami krajín RE na realizáciu Istanbulského dohovoru. Správy GREVIO budú zverejnené pravidelne a skupina odborníkov môže prijať aj konkrétne odporúčania založené na monitorovaní situácie v jednotlivých krajinách. Okrem správ získaných od zmluvných strán (od krajín, ktoré už dohovor ratifikovali a v ktorých už nadobudol platnosť) skupina bude narábať aj s informáciami od mimovládnych organizácií a predstaviteľov občianskej spoločnosti a má právo navštíviť "dotknuté" krajiny za účelom zberu ďalších informácií. Členovia GREVIO musia byť štátnymi príslušníkmi zmluvných strán. Experti tejto skupiny pochádzajú z Albánska, Čiernej Hory, Francúzska, Malty, Portugalska, Rakúska, Srbska, Španielska, Talianska a Turecka. 11 διορισμό των μελών μίας ομάδας, η οποία είναι επιφορτισμένη με την εποπτεία της εφαρμογής της Σύμβασης του Συμβουλίου της Ευρώπης για την Πρόληψη και την Καταπολέμηση της Βίας εναντίον Γυναικών και της Ενδοοικογενειακής Βίας. Οι πρώτες δεκαπέντε χώρες οι οποίες επικύρωσαν τη συγκεκριμένη Σύμβαση, ανέδειξαν, μέσω επιτροπής, δέκα ανεξάρτητους εμπειρογνώμονες, οι οποίοι αποτελούν τα μέλη της ομάδας δράσης κατά της βίας εναντίον γυναικών και της ενδοοικογενειακής βίας(grevio).η GREVIO θα παρακολουθεί τη δράση των κυβερνήσεων, όσον αφορά την εφαρμογή της Σύμβασης, δημοσιεύοντας εκθέσεις και αναφορές σχετικά με την πρόοδο των κρατών και απευθύνοντάς τους σχετικές συστάσεις συμμόρφωσης. Η αναπληρώτρια Γενική Γραμματέας του Συμβουλίου της Ευρώπης, Gabriella Battaini-Dragoni, δήλωσε μετά την ανάδειξη των μελών της GREVIO: «Η αληθινή δοκιμασία ξεκινά τώρα, με την θέση σε ισχύ της Σύμβασης. Το έργο σας σε αυτό τον τομέα θα είναι καθοριστικό». President Komorowski signs anti-violence convention 13/04/ PAP-Radio Poland / Poland President Bronisław Komorowski has signed the Council of Europe's Convention on Preventing and Combating Violence Against Women. Komorowski follows the vote in the lower house of parliament (Sejm) on 16 March, during which 254 MPs voted in favour of ratification, while 175 were against, and 8 abstained. He said on Monday that it would be a ''disgrace'' internationally for Poland if it did not ratify the convention. According to the Council of Europe, the convention has opened the path for creating a legal framework at pan-european level to protect women against all forms of violence, and prevent, prosecute and eliminate violence against women and domestic violence. Nevertheless, the document has proved controversial in Poland, largely due to its emphasis on trying to ''overcome'' gender roles. The convention argues for ''the eradication of prejudices, customs, traditions and other practices which are based on the idea of the inferiority of women or on stereotyped gender roles as a general obligation to prevent violence. Gender studies have repeatedly criticised in Poland by the Church and right-wing parties in recent times, with critics arguing that so-called 11

12 ''gender ideology'' is a threat to the traditional family. Andrzej Duda, Komorowski's rival candidate in May's presidential election, appealed to the head of state to refrain from signing the document. He has claimed that the convention would introduce ''vague concepts'' to the legal system that are alien to Polish culture, traditions and customs, naming ''gender'' as an example. Duda did however stress that he opposes domestic violence. The convention has already been ratified by 15 other European states. M. Komorowski, candidat favori à sa propre succession, a signé la convention dans les locaux du Centre des droits de la femme, une ONG polonaise, à Varsovie. Le président libéral a ainsi ignoré les appels de la droite conservatrice et de l'eglise catholique à bloquer ce document, la Convention d'istanbul sur la prévention et la lutte contre les violences à l'égard des femmes et la violence domestique. Ses détracteurs affirment qu'il introduit dans la culture et le système légal polonais des notions qui lui sont étrangères, dont notamment "la théorie du genre", décriée par l'episcopat polonais comme "extrémiste et néomarxiste". "Il faut respecter les principes et prendre le parti des victimes, des abusés, des faibles", a déclaré le président, 62 ans, à la presse lors de la cérémonie de signature, ajoutant: "on ne doit pas, dans des cas pareils, faire de calculs politiques ou électoraux". Pour son principal rival, candidat conservateur à la présidence Andrzej Duda, 42 ans, la ratification de la Convention représente "une très mauvaise décision". Un sondage publiée la semaine dernière créditait M. Komorowski de 46%, 12

13 et M. Duda de 24% des intentions de vote au premier tour de l'élection présidentielle prévu le 10 mai. Signée le 11 mai 2011 à Istanbul, la Convention a été ratifiée jusqu'ici par une quinzaine de pays, dont la France, l'italie et l'autriche. How the EU can make Women s Day meaningful By Hillary Margolis 08/03/ EUObserver /International What if, this year, the European Union celebrated International Women s Day on 8 March by taking bold action to stop violence against women? The EU can lead by example if it begins the process of ratifying the Istanbul Convention, the ground-breaking Council of Europe treaty to end violence against women. The opportunity for the EU to ratify human rights treaties as an entity has been fairly limited until now, but the Istanbul Convention explicitly provides that option. Violence against women and girls is a vast problem across the European Union. A major study by the EU s Fundamental Rights Agency in 2014 caused shock waves when it found that one in three women surveyed across the EU had experienced physical or sexual violence since the age of 15. Services and support for these women are inadequate in most EU member states. The 2013 annual report from Women against Violence Europe found that only Luxembourg and Slovenia had enough shelter spaces for survivors of violence against women to meet Council of Europe minimum standards. In a recent report, the United Kingdom s Joint Human Rights Committee noted that the UK government, while seen as a leader in bringing 13

14 attention to violence against women abroad, needs to increase efforts to tackle the problem at home. The annual survey by the UK organisation Women s Aid reported that in nearly a third of domestic violence survivors referred to shelters were turned away for lack of space, and 13 percent of responding agencies had closed or suspended services because of insufficient funding. The Joint Human Rights Committee found that shifts in responsibility for allocation of state funds for shelters and other services have left ethnic minority women particularly vulnerable. Close to home Women in Belgium, Hungary, Spain, and the United Kingdom have told Human Rights Watch about horrific abuse by their husbands or partners and a lack of services or support to assist them. Many said police turned them away or humiliated them when they sought help. In a 2013 report on Hungary, Tunde, 21, told Human Rights Watch that her neighbors called the police when they heard her screaming as her husband punched her in the stomach and pushed her into a wall. But when the police arrived, her husband told them the couple had a minor disagreement, and the officers did not question Tunde and her husband separately. They told me to get a medical report and then press charges because the way things stood, they could only interfere if blood flows, Tunde said. The Council of Europe aims to prohibit such inaction: in 2011, it took an ambitious step when it launched the Convention on Preventing and Combating Violence against Women and Domestic Violence, known as the Istanbul Convention after the city where it opened for signature. The convention came into force in Sixteen countries have ratified it, including nine of the 28 EU member states. The Istanbul Convention can save lives in countries that ratify and implement it. The treaty is notably comprehensive and robust, mandating protection 14

15 from all forms of violence against women, including domestic and sexual violence, stalking, harassment, forced marriage, female genital mutilation and forced sterilisation. The treaty covers particularly vulnerable groups such as asylum seekers and undocumented migrants. In countries that ratify, this means that women like Fatima H., who suffered severe domestic violence in Pakistan but lost her asylum claim in the United Kingdom, would have a fair chance to make her case for refuge on the grounds of gender-based violence. Gisele M. It means that women like Gisele M., an undocumented Brazilian migrant in Belgium whose partner stabbed her in the neck with a fork, would have a better shot at receiving protection. When Gisele went to police for help, they did not detain her partner or investigate the case. Instead they accompanied her home to get her passport, took her to the hospital for treatment, and then handed her an order to leave the country within five days. EU ratification of the Istanbul Convention would send a strong signal that combating violence against women and girls is a priority for the European Union and its member states. Ratifying the convention is the right thing for the EU - and all EU member states - to do. What better way to make International Women s Day meaningful? 16 ne occuperà la Bustreo, che è il medico donna tra le italiane che ha raggiunto il livello più alto di carriera nelle Nazioni unite, dopo aver fatto esperienza per contesti di guerra e Paesi in crisi. Ai vertici, sempre a fianco delle donne in difficoltà. Il nuovo piano d azione per la salute delle donne dell Oms è firmato proprio da lei. Ecco le minacce individuate per le quali c è il codice rosso: -lotta alle due principali forme di tumore che interessano le donne (seno e collo dell utero) che ogni anno continuano a mietere oltre un milione di vittime; - salute riproduttiva e sessuale: oltre 222 milioni di donne nel mondo non hanno ancora accesso alla contraccezione; -salute durante gravidanza e parto: nel 2013, oltre 300 mila donne sono morte per quello che dovrebbe essere il momento più bello della loro vita; -Aids e virus Hiv; 4.malattie sessualmente trasmissibili: Hiv e Papilloma virus in testa, seguono clamidia, gonorrea e sifilide (la sifilide non curata è responsabile di oltre 200 mila morti fetali ogni anno); -violenza fisica e sessuale: 1 donna su 3 ha subito una violenza con effetti drammatici sulla salute fisica e psicologica; -salute mentale: le donne sono più esposte a disturbi come ansia, depressione e malattie psicosomatiche; -malattie non trasmissibili (incidenti d auto, abuso di fumo, alcol, uso di sostanze stupefacenti e obesità). Sull obesità, il 50% delle donne in Europa e America è in sovrappeso. attenzione particolare alle giovani donne (sotto i 20 anni), per 13 milioni di loro la salute riproduttiva e sessuale è a rischio. Siamo a 20 anni dalla dichiarazione di Pechino e l impegno globale per l uguaglianza di genere va rinnovato, rilanciato e accelerato. Il 9 marzo se ne parlerà nella sede dell Onu. «Quando penso alle donne e alla loro salute ritengo che abbiamo fatto molti progressi negli ultimi 20 anni - dice Flavia Bustreo -. Con la divisione che dirigo abbiamo ottenuto dei risultati importanti in molti Paesi nel mondo, sia per la salute riproduttiva e sessuale sia per l educazione. Ma la strada da fare è ancora lunga per i diritti delle donne e l uguaglianza di genere, poiché in molti Paesi il potere e la salute delle donne è ancora una chimera e non solo loro ne pagano le conseguenze». Questione prioritaria all attenzione dell Oms è la violenza sulle donne: oggi, nel mondo, infatti, una donna su tre sotto i 50 anni ha subito una qualche forma di violenza fisica o sessuale. Queste hanno il doppio delle probabilità di cadere vittima della depressione o dell alcolismo. Hanno 4,5 volte più probabilità di tentare il suicidio. Il rischio di partorire neonati sottopeso è del 16% superiore alla norma e, in alcune regioni del mondo, 1,5 volte in più è il rischio di contrarre una infezione sessualmente trasmissibile incluso l Hiv (il virus dell Aids) rispetto alle donne non abusate. Peraltro, le donne sono le più inclini a disturbi di ansia, 16

17 depressione e malattie psicosomatiche. E la violenza sulle donne in Italia? «Siamo stati uno fra i primi Paesi a ratificare la Convenzione del Consiglio d Europa sulla prevenzione e la lotta contro la violenza nei confronti delle donne e la violenza domestica (conosciuta come Convenzione di Istanbul), entrata in vigore solo recentemente nell agosto 2014», aggiunge la Bustreo e, quindi, l Oms. La Convenzione costituisce il primo strumento internazionale vincolante sul piano giuridico per prevenire e contrastare la violenza contro le donne e la violenza domestica. Il testo si fonda su tre pilastri - prevenzione, protezione e punizione, ponendo particolare enfasi sui primi due, gli unici in grado di sradicare una violazione dei diritti umani ormai sistemica in Europa e particolarmente grave. Purtroppo, sono ancora molti i Paesi europei che non hanno ratificato il testo. Sono sedici quelli che hanno sottoscritto la Convenzione. In Italia l attenzione è massima, ma nonostante la ratifica nel settembre 2013 il problema resta. Soprattutto da parte delle donne che gli abusi li subiscono. Conclude la Bustreo: «Oltre 100 donne ogni anno vengono uccise in Italia per mano di un uomo. Nella maggior parte dei casi il colpevole è un partner o un ex partner. Gli uomini di casa, mariti, compagni, fidanzati, padri. Solo in rare circostanze si tratta di uno sconosciuto. Ma la violenza domestica è un crimine che in Italia non viene denunciato in oltre il 90% dei casi». Anche questo va cambiato e non bastano le Convenzioni. The treaty stipulates that violence against women is a form De vrouwenbeweging geldt als een van de meest succesvolle sociale veranderingsbewegingen uit de 20e eeuw. Dat blijkt onder andere uit de ontwikkelingen op het terrein van geweld tegen vrouwen. Wat ooit een schaamtevol privéprobleem was, is inmiddels erkend als schending van uiteenlopende mensenrechten. Geweld tegen vrouwen is nationaal en internationaal op de politieke en wetgevende agenda gekomen. De overheid heeft een juridisch verankerde plicht gekregen om geweld als vorm van discriminatie van vrouwen te bestrijden en te voorkomen. Er is veel vooruitgang geboekt. Tegelijkertijd is dat succes mogelijk minder toekomstbestendig dan gehoopt. Juist in tijden van bezuiniging is visie, politieke alertheid en kennis van zaken (juridisch en wetenschappelijk) noodzakelijk om vernieuwingen door te voeren. Kernverplichtingen De grote uitdaging is de verankering van samenhangend beleid dat oog heeft voor de genderspecifieke risico s voor vrouwen. Hierop attendeert ook het College voor de Rechten van de Mens. De bezuinigingen mogen er niet toe leiden dat de kernverplichtingen van de overheid, die voortvloeien uit mensenrechten, in het geding komen. Ook de lokale overheid is verplicht mensenrechten na te leven. Decentralisatie, deregulering en zelfs privatisering zijn op zichzelf geen probleem, zolang de rechten van de mens maar gegarandeerd blijven. Dat is een verantwoordelijkheid die de rijksoverheid nooit kan wegbezuinigen. De afgelopen veertig jaar is veel onderzoek gedaan, dat een unieke verdieping heeft geboden in onze kennis over de aard en de achtergronden van geweld tegen vrouwen. Geweld treft één op drie vrouwen en is mondiaal de meest voorkomende oorzaak van ernstig letsel, verminking en dood van vrouwen. Vanuit oogpunt van publieke gezondheidszorg is de term pandemie de enig passende, aldus de Speciale Rapporteur van de Verenigde Naties over geweld tegen vrouwen. Van privéprobleem, waar de overheid zich tot ver in de jaren 70 van de 19

20 vorige eeuw verre van hield, is anno 2015 geweld tegen vrouwen erkend als een schending van uiteenlopende mensenrechten. De Raad van Europa heeft in 2011 een speciaal mensenrechtenverdrag hieraan gewijd: de Istanbul Conventie ter voorkoming en bestrijding van geweld tegen vrouwen en huiselijk geweld. In het verdrag is bepaald dat geweld tegen vrouwen een vorm van discriminatie is op basis van sekse. De Nederlandse overheid staat op het punt dit verdrag te ratificeren. De inzichten die onderzoek heeft opgeleverd en de wetgeving die daar het gevolg van is, liggen anno 2015 echter opnieuw onder vuur. Dat gebeurt mede onder invloed van een tegenbeweging die zich internationaal aandient. Op politieke en ideologische (soms religieuze) gronden en ongehinderd door wetenschappelijke inzichten, noch door internationaalrechtelijke verplichtingen, wordt kennis over geweld tegen vrouwen soms terzijde geschoven. Het is een paradoxale ontwikkeling, die onderstreept dat de behaalde winst in de veranderingen fragiel is. Perspectief Er is echter ook perspectief op verandering van onderop, ingezet door burgers. Niet alleen vrouwen bevechten de ont- of miskenning van het geweld dat ze meemaken in het openbaar. Ook steeds meer jonge mannen spreken zich openlijk tegen seksueel geweld uit. Neem de Turkse mannen die de afgelopen weken de straat op gingen, gehuld in een rokje, als protest tegen de verkrachting van en moord op een 20-jarige vrouw, en als protest tegen de suggestie dat haar kleding ook maar enige rol zou hebben gespeeld in het geweld.
