1 Consolato Generale d Italia FILADELFIA RIACQUISTO DELLA CITTADINANZA ITALIANA Coloro che hanno perso la cittadinanza italiana a seguito di naturalizzazione statunitense (a qualsiasi titolo o eta ) avvenuta prima del 16 agosto 1992, possono riacquistarla secondo le disposizioni di cui all art. 13 della legge 91/1992 ed in particolare dei commi c) e d) che recitano: c) il punto c. prevede espressamente una dichiarazione di volonta da parte di tutti coloro i quali sono interessati al riacquisto della nostra cittadinanza. Tale dichiarazione di volonta puo essere resa alternativamente: a) presso gli Uffici Consolari di provenienza e successivamente personalmente presentata al Comune ove si desidera stabilire la propria residenza in Italia entro un anno dalla data della dichiarazione. b) direttamente al Comune a cura dell interessato. d) per il punto d. dopo un anno dalla data in cui ha stabilito la residenza nel territorio della Repubblica, salvo espressa rinuncia entro lo stesso termine. (In questo caso d. occorre un visto per residenza elettiva, informazioni nella pagina visti). Nota per il punto c): Se l interessato intende soggiornare in Italia per un periodo inferiore a 90 giorni, non occorre il visto, ma come cittadino ancora straniero dovra adempiere le seguenti formalita previste dalla legge: - Firmare al momento dell ingresso in Italia un documento di residenza denominato Dichiarazione di presenza, disponibile presso le Autorita di Frontiera oppure presso gli Uffici della Prefettura del Comune. Tale dichiarazione e d obbligo ai fini dell iscrizione anagrafica, necessaria per iniziare la procedura di riacquisto della cittadinanza italiana; - Richiedere l Iscrizione anagrafica al Comune prescelto, indicando l intenzione di voler riacquistare la cittadinanza italiana. Qualora la documentazione presentata sia in regola, i Comuni sono tenuti a concedere il riacquisto. Per rendere piu spedita e sicura la procedura di riacquisto, e consigliabile che si scelga l ultimo Comune di residenza in Italia cosi che esso sia gia in possesso degli atti relativi a tutta la storia anagrafica dell interessato.

2 Il punto d) dell art. 13 si differenzia dal precedente in quanto il riacquisto della cittadinanza italiana e automatico, ma avviene, e solo in questo caso, dopo un anno di residenza effettiva in Italia, purche in assenza di una specifica manifestazione di volonta da parte degli aventi diritto. Per riacquistare la cittadinanza italiana, l interessato dovra fornire al Consolato di appartenenza la seguente documentazione: - prova di residenza nella circoscrizione consolare (patente, bolletta elettrica, telefonica o altro); - certificato di nascita; - copia (eventuale) del passaporto italiano; - certificato di naturalizzazione statunitense; - valido passaporto statunitense - licenza e certificato di matrimonio e eventuale decreto di divorzio (se avvenuti negli Stati Uniti muniti di Apostille e traduzione in Italiano). - ricevuta dell avvenuto versamento della tassa di Euro.(Vedere sotto)

6 Consolato Generale d Italia FILADELFIA Reacquisition of Italian Citizenship Those who lost the Italian citizenship as a result of U.S. naturalization (for any reason or at any age) occurring before August 16, 1992, have the possibility of regaining it as per art. 13 of Law 91/1992 and, in particular, as indicated in letters c) and d): c) point c. expressly provides for a declaration of will on the part of all those who are interested in reacquiring our citizenship. This declaration of will can be made either: a) at the consular offices of origin, and then presented to the Comune in Italy where you want to establish residency in Italy, within one year from the date of the declaration, going to the City where he had his last residence. b) directly to the Italian municipality concerned. d) point d. after one year from the date on which he established residence in the territory of the Republic, except with the express renunciation within the same period. In this case d., an elective residence visa is needed (see visa information page). Note for c ) : If the applicant wishes to stay in Italy for a period less than 90 days, he/she does not need a visa, but as a foreign national must fulfill the following formality ' prescribed by law : - Sign at the entrance of residence in Italy a document called "Declaration of presence ", available from the Authority at the Border or at the offices of the Comune Prefecture. This statement will be useful for enrollment registry, which is necessary to begin the process of reacquisition of Italian citizenship ; - Request the registration in the chosen city, indicating his intention to reacquire Italian citizenship. If the submitted documentation is in order, the municipalities are obliged to grant the reacquisition of citizenship. To make it a more speedy and safe procedure, it is advisable that you choose the last place of residence in Italy so that the documents relating to the entire history are already in possession of the local authorities.

7 Point d) of Art. 13 differs from the previous one in that the reacquisition of Italian citizenship is automatic, but it happens, and only in this case, after a year of effective residence in Italy, in the absence of a specific manifestation of will on the part of the beneficiaries. The following documentation is required: - Proof of residency in the jurisdiction of this Consular Office (driver s license and utility bill such as electricity or phone bill). - Birth certificate; - Copy of Italian passport (if available); - Certificate of naturalization (original plus a photocopy); - U.S. passport or valid - All Marriage Licenses, certificates of marriage and eventual divorce decrees (if they occurred in the United States, with Apostille and translation in Italian and must be signed only by the "Clerk" and NOT from the "Assistant Clerk."). - Proof of the 200 Euro wire.(see instructions below)
