3 OPĆI UVJETI za sklapanje Ugovora o korištenju veza br. 01/2009 Članak 1. Opći uvjeti za sklapanje Ugovora o korištenju veza (dalje u tekstu: Uvjeti), primjenjuju se kod sklapanja Ugovora o korištenju veza (dalje u tekstu: Ugovor) i njegov su sastavni dio. Uvjeti se primjenjuju na sve korisnike vezova, vlasnike plovila i njihove opunomoćenike. Marina Hramina d.o.o. (dalje u tekstu: Marina), zadržava pravo promjena odredaba ovih uvjeta. Hrvatski Članak 2. Ugovor se uzastopce produljuje za slijedeće godišnje razdoblje, ukoliko ga niti jedna od ugovornih strana pismeno ne otkaže najmanje 90 dana prije isteka važećeg ugovora. U slučaju nepravovremenog otkaza ugovora, obračunava se i naplaćuje 90 dana dnevnog veza po važećem cjeniku. Članak 3. Marina prema svom planu vezova određuje vez za plovilo i može plovilo prema potrebi premještati o čemu će pravovremeno obavijestiti Korisnika veza. Članak 4. Smatra se da je pružena usluga korištenja veza ako je plovilo na prostoru Marine, potpisan Ugovor o ko-rištenju veza, napravljen popis inventara, predani ključevi i dokumentacija koja omogućuje isplovljenje. Preuzimanjem dokumentacije koja omogućuje isplovljenje od strane Korisnika veza, vlasnika plovila ili njihovih opunomoćenika, smatra se da je plovilo preuzeto. Marina se oslobađa svake odgovornosti bez obzira da li je plovilo u luci ili je u plovidbi. Članak 5. Ukoliko Korisnik veza ne plati naknadu za korištenju veza danom početka važenja Ugovora ili najkasnije u roku od sedam dana od dana početka važenja Ugovora, Ugovor se smatra raskinutim bez daljnjih obavi-jesti. U slučajevima da Korisnik veza danom početka važenja Ugovora ostavi plovilo u Marini, a u narednih sedam dana ne uplati naknadu, Marina će na njegov trošak premjestiti plovilo na suhi vez i od toga dana zaračunavati dnevni vez na kopnu po važećem Cjeniku Marine, kao i ostale nužne troškove, a za proteklo vrijeme zaračunat će cijenu dnevnog veza u moru. Danom raskida Ugovora, u skladu sa stavkom 1. ovog članka, Marina prestaje snositi bilo kakovu odgo-vornost za stanje plovila, a sve štete snosi Korisnik veza. Članak 6. Ugovorne strane su suglasne da Marina ima pravo pridržavanja (retencije) i založno pravo na plovilo Korisnika veza iz članka 1. Ugovora, danom potpisa istog za sva neplaćena potraživanja Marine. Ugovorne strane su suglasne da Marina ima pravo u slučaju postojanja nenaplaćenih potraživanja, premjesti plovilo na suhi vez bez suglasnosti Korisnika veza, te da u istom slučaju odbije obaviti spuštanje plovila u more ili bilo kakove druge usluge dok ne prestanu razlozi iz ovog stavka. Sve troškove radnji iz stavka 1. ovog članka snosi Korisnik veza. Članak 7. Ukoliko Korisnik veza niti po isteku 60 dana od prestanka važenja Ugovora, nije podmirio svoje obveze prema Marini, Marina će pokrenuti sudski postupak, te zatražiti pravo da svoje potraživanje naplati prodajom plovila ili njegovih dijelova. Članak 8. Marina se obvezuje nadoknaditi vlasniku štetu nastalu na plovilu i njegovoj uredno prijavljenoj opremi za vrijeme čuvanja plovila, a za koje štete bi Marina prema zakonskim propisima i obligacijama bila odgovorna. Obvezu naknada takovih šteta Marina preuzima u trenutku kada Korisnik veza izvrši predaju plovila na vez u Marini i izvrši plaćanja, te podmiri sva eventualna dugovanja.

4 Hrvatski Članak 9. Prilikom prvog dolaska u Marinu, sastavit će se popis inventara i ostalih predmeta, a prema Inventarnoj listi. Tako sastavljen popis čini prilog Ugovoru o korištenju veza, a potpisuju ga obje ugovorne strane od kojih svaka zadržava po jedan primjerak. Članak 10. Korisnik veza, vlasnik plovila ili njihovi opunomoćenici, posada ili ostale osobe na plovilu dužne su: - prilikom sklapanja Ugovora o korištenju veza, predati kopiju certifikata plovila i kopiju police osiguranja, - pridržavati se ovih Uvjeta i Pravilnika o redu u luci. Zbog nepridržavanja istih Marina može otkazati Ugovor o korištenju veza, - opremiti plovilo protupožarnim sredstvima koja će efikasno djelovati na samom plovilu. Marina može tražiti dodatna protupožarna sredstva ukoliko smatra da postojeća nisu dovoljna, - čuvati brod i opremu pažnjom dobrog domaćina. Ako Marina smatra da se vlasnik plovila ne odnosi prema imovini kao dobar domaćin, može poduzeti mjere kojima će sačuvati imovinu na teret vlasnika plovila, - svu pokretnu opremu plovila navedenu u Inventarnoj listi spremiti u zatvoreni prostor plovila (zaključati), tako da ne može doći do krađe bez obijanja, - prijaviti svaku izmjenu opreme na Inventarnoj listi, - prijaviti svoj dolazak na recepciji Marine, - ključeve plovila, prilikom odlaska, redovito predati na recepciju Marine. Za plovilo, čiji ključevi nisu u uredu Marine, Marina ne odgovara, - prije svakog napuštanja plovila isključiti sve elektro kabele i vodovodne priključke. Ako to ne učine, osoblje Marine može samo isključiti priključke, a bez prethodne obavijesti, - pridržavati se važećih propisa u pogledu boravka i plovidbe u granicama obalnog mora Republike Hrvatske, - na plovilu staviti vidljivu oznaku imena ili registracije. Ako to ne učine, Marina može postaviti odgovarajuće oznake na trošak vlasnika plovila, - plovilo opremiti kvalitetnim odgovarajućim konopima i ceradom. Uočene nedostatke navedene opreme broda Marina može otkloniti na račun vlasnika plovila bez prethodnog obavještenja, - nadoknaditi štetu na plovilima, automobilima i opremi trećih osoba koju je prouzrokovala posada ili je nastala kao posljedica lošeg održavanja plovila ili opreme, - privez plovila izvesti pravilno sa konopima koji trebaju biti kvalitetni i dovoljno dimenzionirani, odnosno prema zahtjevu i uputstvu osoblja Marine. Ako plovilo nije privezano ili je nepravilno privezano, Marina će ga privezati na trošak vlasnika plovila. - priključak na elektro i vodovodnu instalaciju obavezno skinuti nakon odlaska sa plovila, - priključak na razvodni ormarić izvesti samo sa ispravnim kabelom i sigurnonosnom sklopkom koja je maksimalno dozvoljena na utičnici, - priključak na vodovodnu instalaciju izvršiti samo ispravnim crijevom koje na kraju ima ventil za zatvaranje, - za obavljanje traženih radova na plovilu dati na uvid tehničku dokumentaciju iz koje se može točno uočiti način rješavanja tehničkog zadatka, - posebno kod dizanja plovila upozoriti na opremu na podvodnom dijelu plovila i dati točne podatke o položaju iste. Članak 11. Marina nije u obvezi nadoknaditi štete niti snositi odgovornost za troškove u slijedećim slučajevima: - štete kao posljedice više sile, - štete na plovilu proizašle kao posljedica zlonamjernog postupka ili grube nemarnosti vlasnika ili korisnika, posade ili drugih osoba na plovilu, - štete proizašle zbog neodržavanja, zapuštenosti ili dotrajalosti plovila ili opreme, - štete kao posljedica skrivene mane, - šteta iz naslova gubitka vremena, zarade zakašnjenja korištenja godišnjih odmora i sl., - šteta na opremi ili nestanak oprema koja nije u popisu inventara, - šteta na opremi ili nestanak iste koja je na popisu inventara, a nije bila u zaključanom prostoru, - krivnje trećih osoba, - krađe ili štete nastale iz bilo kojeg razloga na umjetničkim slikama, te predmetima od plemenitih metala, novcu, vrijednosnim papirima i sl., - štete nastale od glodara na plovilu, - štete nastale uslijed zamrzavanja i zaleđivanja sistema za hlađenje motora,

5 - štete koje bi nastale na plovilu kada se ključevi i plovidbena dozvola ne nalaze na recepciji Marine, - štete proizišle zbog nestručno izvedene elektro ili vodovodne instalacije na plovilu, odnosno od priključka na gatu do plovila - štete proizašle zbog pucanja konopa koji pripadaju plovilu, - štete proizašle zbog nepridržavanja Uvjeta i Pravilnika o redu u luci, - štete proizašle iz nepridržavanja carinskih, lučkih i drugih upravnih propisa, - nestanak bokobrana, konopa, sidra, konopa, propelera i druge opreme koju se može demontirati s broda bez obijanja, - štete na plovilu, nastale kao posljedica oštećenja od strane drugog broda. - troškove uklanjanja podrtine, - štete uslijed zagađivanja, - štete na fotoaparatima, kamerama, radioprijemnicima, TV prijemnicima i dalekozorima, osim za štete nastale uslijed potonuća, požara, eksplozije, krađe ili nestanka plovila do kojih je došlo krivnjom Marine, - štete od požara ili eksplozije ukoliko korisnik veza, vlasnik ili treća osoba nije poštivao propise o zaštitnim mjerama prema pravilnicima Marine, - bilo koje druge štete koja nije uzrokovana odgovornošću Marine iz Ugovora o korištenju veza. Hrvatski Članak 12. Niti jedna ugovorna strana neće se smatrati odgovornom za neuredno izvršenje Ugovora, ako do istog dođe uslijed više sile. Pod višom silom podrazumijevaju se izvanredne vanjske okolnosti koje nastanu nakon sklapanja Ugovora, a prije roka za ispunjenje određene obveze čije nastupanje ugovorne strane nisu mogle predvidjeti, izbjeći niti otkloniti, a onemogućavaju ispunjenje ugovorne obveze jednoj od ugovornih strana kao što su npr. orkansko nevrijeme, iznimni plimni val, potres, požar, epidemija, druge prirodne katastrofe ili nepogode, mjere državnih organa, štrajk, građanski nemiri, rat. Članak 13. Ugovor prestaje, osim isteka razdoblja na koji je sklopljen i u slijedećim uvjetima: a) u slučaju sporazumnog raskida Ugovora, b) jednostranim raskidom Ugovora prije isteka ugovorenog razdoblja i to: - ako jedna ugovorna strana ne poštuje ili ne ispunjava bitne obveze po Ugovoru i Uvjetima, kao što su pravo korištenja veza i pravovremeno plaćanje, - ako uslijed više sile dođe do nemogućnosti ispunjenja neke od bitnih obveza po Ugovoru i Uvjetima, - u slučaju uništenja veza uslijed više sile. U tom slučaju Korisnik veza ima pravo na vraćanje odgovarajućeg dijela naknade za korištenje veza, razmjerno neiskorištenom vremenu do isteka ugovorenog razdoblja tim što se Marina može osloboditi obveze vraćanja dijela naknade ako ponudi Korisniku veza drugi odgovarajući vez na korištenje, a Korisnik veza ga prihvati, - ako Korisnik veza ili vlasnik proda plovilo. Ugovorna strana koja je svojom krivnjom prouzrokovala razlog za raskid Ugovora, nema pravo na jednostrani prijevremeni raskid Ugovora. Jednostrani prijevremeni raskid vrši se izjavom koju ugovorna strana koja raskida Ugovor dostavlja drugoj strani u kojoj navodi razlog raskida Ugovora, osim u slučaju iz članka 1. stavak 1. ovih Uvjeta. Ugovorna strana koja je svojom krivnjom prouzrokovala razlog za raskid Ugovora, odgovara drugoj za štetu koja je počinjena prestankom Ugovora. U slučaju sporazumnog ili jednostranog raskida Ugovora o korištenju veza, Marina nije obvezna izvršiti povrat uplaćenih sredstava. Marina pridržava pravo da po isteku Ugovora ne sklopi novi Ugovor ili ga ne produži. Članak 14. Prije ostavljanja plovila na čuvanje i održavanje ugovorna strana je dužna ispuniti Narudžbu radova za zimu. Članak 15. Korisnik veza nema pravo trajno ili privremeno iznajmljivati ili ustupiti vez trećim osobama. Članak 16. Za vrijeme izbivanja plovila, Marina može iznajmiti vez drugom korisniku. Korisnik veza, vlasnik plovila ili njihov opunomoćenik dužni su prijaviti svako izbivanje plovila. Izbivanje plovila iz Marine ne odbija se od cijene veza.

6 Članak 17. Na plovila koja su za prodaju nije dozvoljeno stavljati natpis za prodaju. Osoblje Marine će ukloniti natpis bez prethodne obavijesti. Vlasnik plovila upućuje se na Ured za posredovanje. Članak 18. Korištenje plovila od drugih osoba koje nisu korisnik veza ili vlasnik plovila, može se vršiti samo uz pismeno odobrenje Korisnika veza ili vlasnika. Usluga boravka na prostoru Marine naplaćuje se prema važećem cjeniku. Hrvatski Članak 19. Radovi koje Korisnik veza, vlasnik plovila ili njihovi opunomoćenici, posada i ostale osobe na plovilu (izričito opunomoćene), naručuju van ugovorene obveze, plaćaju se odmah nakon izvršenog rada, a po primitku računa. Eventualne reklamacije naručitelj radova je dužan pismeno prijaviti najkasnije u roku od 30 dana po primitku računa. Članak 20. Servisni popravci i radovi na plovilu i motoru, mogu se obavljati samo na prostoru servisne zone. Rad trećim osobama dozvoljen je samo uz suglasnost Marine. Na operativnom prostoru dizalice, navoza i ostale transportne opreme nije dozvoljeno kretanje neovlaštenih osoba. Članak 21. Korisnik veza ili vlasnik plovila obvezan je osigurati plovilo i opremu od građanske odgovornosti prema trećim osobama, uključujući eventualne štete počinjene drugim plovilima ili Marini. Plovila koja nisu osigurana neće se primiti u Marinu, odnosno ne preuzima se nikakva odgovornost za štete na takovom plovilu. Marina pridržava pravo premjere dužine plovila. Članak 22. Članak 23. Marina ne odgovara za štetu i druge posljedice koje nastaju zbog nepridržavanja Ugovora, ovih Uvjeta, i Pravilnika o redu u luci. Članak 24. Ovi Uvjeti primjenjuju se od dana donošenja. Danom početka primjene ovih Uvjeta prestaju važiti Opći uvjeti za sklapanje ugovora o korištenju veza od 01. siječnja godine. U Murteru. 01. siječnja godine Uprava marine Hramina d.o.o.

7 PRAVILNIK O REDU U LUCI MARINA HRAMINA Članak 1. Prilikom dolaska u Marinu Hramina d.o.o. (dalje u tekstu: Marina), svi gosti dužni su prijaviti svoj boravak uz predočenje putovnice ili osobne iskaznice. Članak 2. Plovilo, pomoćni čamac, prikolica i automobil moraju se obilježiti na vidljivom mjestu oznakom Marine i imenom plovila ili nekom drugom oznakom koju odredi Marina. Hrvatski Članak 3. Parkiranje vozila i prikolice vlasnik je dužan vršiti u skladu sa prometnim propisima, na za to određenom prostoru, pri čemu Marina ne odgovara za eventualno nastalu štetu na vozilima i prikolici, niti za otuđenje istih. Članak 4. Pomoćni čamac, surfinge, satelitske antene ili drugu opremu nije dozvoljeno montirati ili držati na gatovima ili u moru, već samo na za to određenom prostoru. Članak 5. Nije dozvoljeno narušavati mir ostalih gostiju. U noćno vrijeme od 22,00 do 8,00 sati zabranjeno je galamiti i stvarati buku. Članak 6. Za vrijeme boravka u Marini zabranjuje se upotreba brodskog WC-a. Članak 7. Korisnici veza moraju postavljati konope i bokobrane tako da ne ometaju plovidbu ostalih gostiju. Unutar Marine nije dozvoljeno postavljanje plutača. Članak 8. Otpadna ulja, naftu i zauljene vode i fekalije, ostatke masnoća i deterdženta ili ostatke tereta s broda, moraju se odlagati u za to postavljene posude i uređaje za rukovanje i prihvat krutog i tekućeg otpada, a sve u skladu s odredbama MARPOL konvencije. Članak 9. Na području Marine nije dozvoljeno paliti vatru ili izvoditi takove radnje sa kojima bi se mogao izazvati požar. Članak 10. U Marini nije dozvoljeno glisiranje, vožnja plovilom brzinom većom od dozvoljene ili vožnja na način kojim bi se ugrožavala sigurnost ostalih plovila. Surfing ili ribolov nije dozvoljen u akvatoriju Marine bliže od 200 m. Kupanje je dozvoljeno na samo za to određenim mjestima. Članak 11. U Marini nije dozvoljeno slobodno puštati pse bez uzice. Članak 12. Servisni popravci i radovi na plovilu i motoru, mogu se obavljati samo na prostoru servisne zone. Rad trećim osobama dozvoljen je samo uz suglasnost Marine. Na operativnom prostoru dizalice, navoza i ostale transportne opreme nije dozvoljeno kretanje neovlaštenih osoba.

8 Članak 13. Nije dozvoljeno vješanje rublja na gatovima ili prostoru Marine. Članak 14. Nije dozvoljeno postavljanje posebnih natpisa, reklama ili oznaka za prodaju. Hrvatski Članak 15. Ulaskom u prostor Marine, svi gosti dužni su se ponašati u skladu s ovim Pravilnikom. Članak 16. Svoje primjedbe gosti Marine mogu prijaviti u ured Marine ili ih upisati u knjigu žalbe. Članak 17. Zbog nepridržavanja odredaba ovog Pravilnika, Marina može otkazati Ugovor o korištenju veza. U Murteru, 01. siječnja godine Uprava marine Hramina d.o.o.

9 GENERAL TERMS for the conclusion of a Contract on the use of berth No. 01/2009 Article 1 General Terms for the conclusion of a Contract on the use of berth (hereinafter: the Terms) are integral part of the Contract. The Terms shall apply to all customers, vessel owners, and their attorneys. Marina Hramina d.o.o. (hereinafter: the Marina), retains the right to amend the Terms. Article 2 The Agreement shall be automatically extended to subsequent period of one year, unless one of the Parties terminates it by a written notification at least 90 days before the expiry of the valid Agreement. In the event of untimely termination, a fee for 90 days of daily berth shall be charged according to the applicable price list. Article 3 The Marina shall, in accordance with its berth plan, determine the berth for a vessel, and it can relocate the vessel if need be, notifying the customer on time. Article 4 It shall be considered that the service of berth use has been provided if the vessel is in the Marina area, the Contract has been signed, a list of inventory has been made, and the keys and documentation enabling set out have been submitted. On accepting the documentation from the customer, vessel owner of their attorneys that enables set out, it shall be considered that the vessel has been accepted for berth. The Marina shall be free of any responsibility, whether the vessel is in the Marina or sailing. English Article 5 If the customer has not paid the fee for the berth as of the date of or within seven days from the beginning of the Contract, the Contract shall be considered terminated without further notice. If the customer leaves the vessel in the Marina at the beginning of the Contract and does not pay the fee within the next seven days, the Marina shall at his expense relocate the vessel in a dry-dock and from then on charge daily dry berth pursuant to the relevant price list of the Marina, plus other necessary costs, while for the time before that the Marina shall charge the daily berth in the sea. As of the date of the termination of the Contract, and pursuant to paragraph 1 of this Article, any responsibility of the Marina shall cease with regard to the repair of the vessel, and any damage shall be covered by the customer. Article 6 The Contracting Parties agree that the Marina shall, as of the date of signing the Contract, be entitled to retention and lien with regard to the vessel of the customer mentioned in Article 1 of the Contract to compensate for any outstanding payments to the Marina. The Contracting Parties agree that the Marina shall, in case of outstanding payments, be entitled to relocate the vessel in dry dock without the approval of the customer and to decline to lower the vessel into the sea or to perform any other services until the reasons mentioned in this paragraph have ceased. Any costs mentioned in paragraph 1 of this Article shall be borne by the customer. Article 7 If within 60 days from the ceasing of the Contract the customer does not pay what he owes to the Marina, the Marina shall refer the matter to the court claiming the right to satisfy its claim through the sale of the vessel or its parts. Article 8 The Marina shall indemnify the owner for any damage sustained by the vessel and its duly registered equipment while the vessel was kept in the Marina, according to statutory provisions. The Marina shall be committed to such indemnification when the customer brings the vessel to berth at the Marina and effects payments, and pays any outstanding debts.

10 Article 9 During his first arrival in the Marina, a list of inventory and other items shall be prepared in accordance with the Inventory List form. Such list shall be enclosed to the Contract, signed by both Contracting parties of which each shall keep a copy. English Article 10 The customer, owner, or their attorneys, crew, or other persons on the vessel shall: - upon concluding the Contract submit a copy of the vessel certificate and a copy of the insurance policy, - comply with these Terms and the Rules of Order in the Marina. Non-compliance may cause the Marina to cancel the Contract, - equip the vessel with firefighting equipment to be effectively employed on the vessel itself. The Marina may require additional equipment if the available one is considered insufficient, - keep the vessel and equipment with due care. If the Marina considers that the owner of the vessel does not treat the property duly, it may undertake measures to preserve the property at the expense of the vessel owner, - put (lock) any movable vessel equipment from the Inventory List in a closed space of the vessel, so that nothing can be stolen without breaking in, - report any change in the equipment from the Inventory List, - report his arrival at the reception desk of the Marina, - always leave the keys of the vessel at the reception desk of the Marina on leaving. the Marina shall not be liable for the vessels whose keys are not deposited with the Marina office, - always disconnect all electrical cables and water supply connections prior to leaving the vessel. If the customers do not do this, the staff of the Marina may disconnect any services without prior notice, - abide by the relevant regulations concerning the stay and navigation within the borders of the coastal waters of the Republic of Croatia, - visibly mark the vessel with its name or registration. This failing, the Marina may put the appropriate marks itself at the expense of the owners of the vessels, - equip the vessel with appropriate quality ropes and tarpaulin. Any deficiencies in the vessel s equipment may be made good by the Marina at the expense of the vessel s owner without prior notice, - indemnify third parties for any damage to their vessels, cars and equipment caused by the crew or as a consequence of bad maintenance of the vessel or its equipment, - tie the vessel properly with the ropes that must be of good quality and strong enough, or as required and instructed by the staff of the Marina. If the vessel is not tied or is tied improperly, the Marina shall tie it at the expense of the vessel s owner. - always remove the power and water supply services connections on vessel s departure, - connect to the power switch cabinet only with proper cable and maximum allowed security switch for the outlet, - connect to the water supply services only with a correct hose with a stop valve on its end, - in order to have the requested works on the vessel done, submit technical documentation of the vessel showing precisely how the technical issue is to be tackled, - particularly when lifting the vessel, warn about the equipment of the vessel below the waterline and give accurate information on the position of the same. Article 11 The Marina shall not be under obligation to pay damages or be liable for the costs of the following: - damage incurred as a consequence of force majeure, - damage to the vessel caused maliciously or through gross negligence of the owner or user, the crew or other persons on the vessel, - damage caused by the lack of maintenance, the neglect or wearing out of the vessel or its equipment, - damage caused by a hidden flaw, - damage caused by the loss of time, earning, delay in vacationing etc., - damage to the equipment or loss of the equipment that was not reported in the Inventory List, - damage to the equipment or loss of the equipment from the Inventory List that was not stored under lock, - liabilities caused by third parties, - theft or damage for whatever reason to paintings and items made of precious metals, money, securities, etc., - damage to the vessel caused by rodents, - damage caused by the freezing of the engine cooling system,

11 - damage to the vessel incurred during the time in which the keys and the navigation permit are not at the reception desk of the Marina, - damage caused by improper connection of the power or water supply installations or services from the pier to the vessel - damage caused by broken ropes that belong to the vessel, - damage caused by the non-compliance with the Terms and the Rules of Order in the Marina, - damage caused by non-compliance with the customs, port and other regulations, - loss of fenders, ropes, anchors, propellers and other equipment that cannot be disassembled without prying it loose, - damage to the vessel caused by another vessel, - costs of the removal of the wreck, - damage caused by the pollution, - damage to cameras, video-cameras, radio sets, TV sets and binoculars, except damage caused by sinking, fire, explosion, theft or disappearance of the vessel for which the Marina is liable, - damage caused by fire or explosion if the customer, owner or a third party did not comply with the protection measures in accordance with the Rules of the Marina, - any other damage that was not related to the liability of the Marina under the Contract. Article 12 Neither Contracting Party shall be considered liable for irregular Contract performance if this is caused by force majeure. Force majeure includes extraordinary circumstances that occur after the conclusion of the Contract but prior to the expiry of the deadline for meeting a particular requirement, which the Contracting Parties could not have anticipated, avoided or deflected, and which makes it impossible for one of the Contracting Parties to deliver as agreed, such as i.e. storm, tidal wave, earthquake, fire, epidemic, other natural disasters or accidents, government measures, strike, civil strife, war. English Article 13 The Contract shall cease, besides the expiry of the period for which it was concluded, in the following cases: a) amicable termination of the Contract, b) unilateral termination of the Contract prior to its expiry if: - either of the Contracting Parties does not comply with or fulfill the essential requirements of the Contract or the Terms, e.g. the right to use berth and timely payment, - owing to force majeure some of the essential obligations under the Contract and the Terms cannot be fulfilled, - the berth is destroyed due to force majeure. In such case the customer shall be entitled to the return of the corresponding portion of the fee in proportion with the non-used time left until the expiry of the Contract period, but the Marina may be exempted from the obligation to reimburse a portion of the fee if its offers the customer another adequate berth, and the customer accepts it, - the customer or the owner sells the vessel. The Contracting Party responsible for the termination of the Contract shall not be entitled to a unilateral early termination of the Contract. The unilateral early termination of the Contract shall be carried out through a notice submitted by the terminating party to the other party stating the reason for the termination of the Contract, except in the case from Article 1 para 1 hereof. The Contracting Party responsible for the termination of the Contract shall be liable to the other Contracting Party for any damage incurred from the termination of the Contract. In the case of amicable or unilateral termination of the Contract on berth use, Marina is not obligated to make any refunds. The Marina reserves the right not to conclude a new Contract or extend the available one after the expiry of the Contract. Article 14 Prior to leaving the vessels for the keeping and maintenance, the Contracting Party shall fill in the Winter Maintenance Order. Article 15 The customer shall not be entitled to permanently or temporarily sublease the berth to third parties or grant them the use of the same. Article 16 During the absence of the vessel, the Marina may lease the berth to another customer. The customer, the owner of the vessel, or their attorneys, shall report all absences of the vessel. Absence from the Marina shall not be deductible from the berth fee.

12 Article 17 It is not allowed to put For Sale signs on the vessels to be sold. The staff of the Marina will remove any such signs without prior notice. The owner of the vessels is herewith referred to the Sales Mediation Office. Article 18 Vessels may be used by persons other than the customers or vessel owners solely with the written approval of the customer or vessel owner. Accommodation in the Marina shall be charged in accordance with the relevant price list. Article 19 Works ordered by the customer, vessel owner, or their attorneys, crews and other persons on the vessel (explicitly authorized), in excess of the contractual obligation, shall be paid promptly after the work has been done and invoiced. The ordering party shall report any complaints within 30 days from receiving the bill. Article 20 Maintenance repairs and works on the vessel and the engine may only be carried out in the area of the maintenance zone. The work of third parties is permitted only with the prior consent of the Marina. Unauthorised persons are forbidden to enter the working area of the crane, slipway and other manipulation equipment. English Article 21 The customer or vessel owner shall insure the vessel and the equipment against third party liability, including possible damage to other vessels or the Marina. Non-insured vessels shall not be admitted to the Marina, i.e. no liability for damage to such vessel shall be accepted. Article 22 The Marina shall reserve the right to measure the length of the vessel. Article 23 The Marina shall not be liable for the damage and other consequences of the non-compliance with the Contract, these Terms, and the Rules of Order in the Marina. Article 24 These terms shall be in effect from the date below. Upon the date of application of these Conditions, the General Terms for conclusion of a Contract on the use of berth of 1 January 2005 shall cease to be in effect. 13 RULES OF ORDER IN THE HRAMINA MARINA Article 1 On the arrival to Marina Hramina d.o.o. (hereinafter: Marina), all visitors shall register, showing their passports or IDs. Article 2 The vessel, lifeboat, trailer and vehicle shall be marked in a visible place with the mark of the Marina and the name of the vessel, or some other mark determined by the Marina. Article 3 The owner shall park his vehicle and trailer in conformity with the traffic rules in the area designated for this purpose, and the Marina shall not be responsible for any damage to the vehicle and the trailer or for them being stolen. Article 4 Lifeboats, surfboards, satellite dishes or other equipment shall not be installed or held on the piers or in the sea, but only in the areas designated for such purpose. Article 5 It is not allowed to disturb the peace and quiet. From h in the evening to 8.00 h in the morning, it is forbidden to make loud noise. English Article 6 During the stay in the Marina the use of the boat s lavatory is forbidden. Article 7 Customers shall take care that their ropes and fenders do not impede the navigation of other visitors. Within the Marina, no buoys are allowed. Article 8 Used oil, water contaminated with petroleum, grease or faecal matter, petroleum or the remains of grease and detergent shall be disposed of in available the disposal containers and devices for the handling and receipt of solid and liquid waste, in accordance with the provisions of the MARPOL Convention. Article 9 On the territory of the Marina it is forbidden to build fires or engage in any activities that may lead to a fire. Article 10 In the Marina, no skimming, speeding or reckless driving compromising the safety of others shall be allowed. Surfing or fishing shall not be allowed within 200 m of the Marina. Bathing is only allowed in places designated for this purpose. No dogs shall move about the Marina without a leash. Article 11 Article 12 Maintenance repairs and works on the vessel and the engine may only be carried out in the area of the maintenance zone. The work of third parties is permitted only with the prior consent of the Marina. Unauthorised persons are forbidden to enter the working area of the crane, slipway and other manipulation equipment. Article 13 It is forbidden to hang laundry on the piers or in the area of the Marina.

14 Article 14 It is forbidden to set up private signboards, advertisements and signs advertising sales. Article 15 On entering the Marina, all visitors must behave in conformity with these Rules. Article 16 The visitors of the Marina may report their complaints to the Marina Office or enter them in the Complaint s Book. Article 17 In case of non-compliance with the provisions of these Rules, the Marina may cancel an individual Contract on the Use of Berth. 15 ALLGEMEINE BEDINGUNGEN für den Abschluss des Vertrags über die Liegeplatzvermietung Nr. 01/2009 Artikel 1 Die Allgemeinen Bedingungen für den Abschluss des Vertrags über die Liegeplatzvermietung (nachstehend: Allgemeine Bedingungen) sind ein Bestandteil des Vertrags. Die Allgemeinen Bedingungen gelten für alle Liegeplatzbenützer, Wasserfahrzeugeigentümer, bzw. deren Bevollmächtigten. Marina Hramina d.o.o. (nachstehend: die Marina), behält sich die Änderungen dieser Bedingungen vor. Artikel 2 Sollte der Vertrag von keinem der Vertragsteile mindestens 90 Tage vor dem Ablauf des gültigen Vertrages schriftlich nicht gekündigt werden, wird dann der Vertrag ununterbrochen um den nächsten Jahreszeitraum verlängert. Im Falle der nicht rechtzeitigen Vertragskündigung, werden tägliche Liegeplatzgebühren für 90 Tage laut der geltenden Preisliste berechnet und entrichtet. Artikel 3 Gemäß Liegeplatzplan bestimmt die Marina den Liegeplatz für das Wasserfahrzeug und sie kann das Wasserfahrzeug bei Bedarf auch verlagern, worüber sie den Liegeplatzbenützer rechtzeitig benachrichtigen wird. Artikel 4 Es wird angenommen, dass die Dienstleistung der Liegeplatzbenutzung geleistet wurde, wenn sich das Wasserfahrzeug in der Marina befindet, der Vertrag unterzeichnet, das Inventarverzeichnis erstellt ist und die Schlüssel und die Dokumente, welche das Ausfahren ermöglichen, abgegeben wurden. Bei der Abgabe der erwähnten Dokumente seitens des Kunden, Wasserfahrzeugeigentümers bzw. ihren Bevollmächtigten, wird angenommen, dass das Wasserfahrzeug von der Marina aufgenommen wurde. Die Marina ist frei von jeglicher Haftung, egal ob sich das Wasserfahrzeug in der Marina befindet oder schwimmt. Artikel 5 Falls der Kunde das Entgelt für den Liegeplatz am Tag bzw. innerhalb von sieben Tagen ab dem Beginn des Vertrags nicht leistet, wird angenommen, dass der Vertrag ohne weitere Ankündigung gekündigt wurde. Wenn der Liegeplatzbenützer sein Wasserfahrzeug ab dem ersten Tag der Vertragsgültigkeit in der Marina lässt und die Kosten nicht innerhalb der folgenden sieben Tage begleicht, wird die Marina das Wasserfahrzeug auf seine Kosten auf einen Winterliegeplatz verlegen und von da an die tägliche Vergütung für den Winterliegeplatz gemäß ihrer gültigen Preisliste sowie alle anderen notwendigen Kosten verrechnen. Für die restliche Zeit wird der Tagesliegeplatzpreis im Meer verrechnet. Mit dem Tag der Beendigung des Vertrags und gemäß Absatz 1 dieses Artikels endet jede Haftung der Marina bezüglich des Zustands des Wasserfahrzeugs. Der Liegeplatzbenützer kommt dann für jegliche Schäden selbst auf. Artikel 6 Die Vertragsparteien sind sich einig, dass die Marina mit dem Tag der Unterzeichnung desselben das Zurückbehaltungsrecht (Retentionsrecht) und das Pfandrecht auf das Wasserfahrzeug des Liegeplatzbenützers aus Artikel 1 des Vertrags für alle offenen Forderungen der Marina hat. Die Vertragsparteien sind sich einig, dass die Marina im Fall eines Bestehens offener Forderungen das Recht hat, das Wasserfahrzeug auf den Winterliegeplatz ohne Zustimmung des Liegeplatzbenützers zu verlegen, und in demselben Fall zu verweigern, das Wasserfahrzeug ins Meer zu lassen oder jegliche andere Dienstleistungen zu leisten, solange die erwähnten Gründe aus diesem Absatz existieren. Alle im Absatz 1 dieses Artikels erwähnten Kosten werden vom Liegeplatzbenützer getragen. Artikel 7 Falls der Liegeplatzbenützer innerhalb von 60 Tagen ab Vertragsende seine Schulden an die Marina nicht begleicht, wird die Marina ein Gerichtsverfahren einleiten und ihre Forderung durch Verkauf des Wasserfahrzeugs bzw. seiner Teile begleichen. Artikel 8 Die Marina verpflichtet sich, dem Eigentümer den Schaden, der am Wasserfahrzeug und an seiner ordentlich angemeldeten Ausstattung in der Zeit der Hortung des Wasserfahrzeugs entstanden ist, und für welche die Marina laut gesetzlichen Vorschrif-

16 ten und Obligationen haftet, zu ersetzen. Die Marina übernimmt die Schadenersatzverpflichtung ab dem Moment, ab dem der Liegeplatzbenützer die Übergabe des Wasserfahrzeugs für einen Liegeplatz durchführt, bezahlt und alle eventuellen Schulden beglichen hat. Artikel 9 Bei seiner ersten Ankunft in die Marina wird ein Liste des Inventars und der restlichen Gegenstände laut Inventurliste erstellt. Eine solch zusammengestellte Liste stellt die Anlage des Liegeplatzvertrages dar und wird von beiden Vertragsparteien unterzeichnet, wobei jede Vertragspartei je eine Ausfertigung behält. Artikel 10 Der Liegeplatzbenützer, Wasserfahrzeugeigentümer, bzw. ihre Bevollmächtigten, Besatzung oder andere Personen am Bord sind verpflichtet: - während des Vertragsabschlusses eine Kopie des Wasserfahrzeugsscheins und der Versicherungspolizze abzugeben, - diese Allgemeinen Bedingungen und die Hafenregeln zu beachten. Bei Nichtbeachtung kann die Marina den Liegeplatzvertrag kündigen, - das Wasserfahrzeug mit Feuerlöschgeräten auszustatten, die effizient im Wasserfahrzeug funktionieren. Die Marina kann zusätzliche Brandschutzmittel verlangen, wenn die vorhandenen als nicht ausreichend bewertet werden, - das Schiff und seine Ausstattung mit der im Verkehr erforderlichen Sorgfalt zu wahren. Wenn die Marina erachtet, dass der Eigentümer des Wasserfahrzeugs sich gegenüber seinem Eigentum nicht mit der im Verkehr erforderlichen Sorgfalt verhält, kann sie Maßnahmen ergreifen, mit welchen sie das Eigentum auf Kosten des Wasserfahrzeug- Eigentümers wahren wird, - die gesamte bewegliche Wasserfahrzeugausstattung, die in der Inventarliste angeführt ist, muss in einen geschlossenen (und abgeschlossen) Wasserfahrzeugraum aufbewahrt werden, damit es nicht zu einem Diebstahl kommt, der ohne ein Aufbruch vollzogen werden kann, - jede Änderung der Ausstattung, die in der Inventarliste angeführt ist, anzumelden, - die Ankunft an der Rezeption der Marina anzumelden, - die Schlüssel des Wasserfahrzeugs bei jedem Verlassen an der Rezeption der Marina abzugeben. Die Marina haftet nicht für die Wasserfahrzeuge, deren Schlüssel nicht im Marinabüro abgegeben wurden. - immer alle Stromkabel und Wasserleitungen vor dem Verlassen abzuschalten. Wenn der Kunde dies nicht tut, kann das Personal der Marina alle Anschlüsse ohne vorherige Warnung abschalten, - die gültigen Vorschriften im Zusammenhang mit dem Aufenthalt und der Navigation in den Küstengewässern der Republik Kroatien zu beachten, - an das Wasserfahrzeug seinen Namen bzw. das Registrierkennzeichen an einem sichtbaren Platz zu befestigen. Ansonsten kann die Marina entsprechende Markierungen selbst auf Kosten des Wasserfahrzeug - Eigentümers vornehmen, - das Wasserfahrzeug mit entsprechenden Qualitätsleinen und -seilen und einer Plane auszustatten. Die Marina ist berechtigt, jegliche Mängel bei der Ausstattung des Wasserfahrzeugs auf Kosten des Eigentümers und ohne vorherige Benachrichtigung zu beseitigen, - Dritte für alle Schäden an ihren Wasserfahrzeugen, Autos oder Ausstattung zu entschädigen, welche durch die Besatzung oder als Folge schlechter Wartung des Wasserfahrzeugs bzw. der Ausstattung entstehen, - das Wasserfahrzeug ordentlich an der Pier mit einem Seil festzumachen, das von guter Qualität und stark genug bzw. gemäß Auflagen oder Hinweisen des Personals der Marina sein muss. Wenn das Wasserfahrzeug nicht bzw. nicht richtig festgemacht ist, wird die Marina es auf Kosten des Eigentümers festmachen. - beim Verlassen des Wasserfahrzeugs immer die Anschlüsse für die Strom- und Wasserleitungsinstallationen demontieren, - Anschluss an den Schaltschrank nur mit richtigem Kabel und max. zugelassener Steckdosensicherung ausführen, - den Anschluss an die Wasserleitung nur mit richtigem Schlauch, welches ein Verschlussventil am Ende aufweist, vorzunehmen, - um die erforderlichen Arbeiten am Wasserfahrzeug vornehmen zu lassen, ist es notwendig, die technische Unterlagen des Wasserfahrzeugs zur Verfügung zu stellen, aus welchen ersichtlich ist, wie das technische Problem zu lösen sei, - insbesondere beim Heben des Wasserfahrzeugs warnen, ob sich eine Ausstattung unterhalb der Wasserlinie befindet und genaue Auskunft über deren Lage zu geben. Artikel 11 Die Marina ist in folgenden Fällen zur Entschädigung nicht verpflichtet bzw. übernimmt die Haftung nicht: - bei Schäden als Folge höherer Gewalt, - bei vom Eigentümer oder Benutzer bzw. von der Besatzung oder anderen Personen am Bord absichtlich bzw. durch grobe Fahrlässigkeit verursachte Schäden, - bei Schäden, die durch mangelnde Wartung, Verwahrlosung bzw. Verschleiß des Wasserfahrzeugs oder seiner Ausstattung entstanden sind,

17 - Schäden durch einen verborgenen Defekt, - Schäden durch Verlust der Zeit, des Gewinns der Verspätung der Nutzung des Urlaubs usw., - Schäden an der Ausstattung bzw. Verlust der Ausstattung, welche nicht in der Inventarliste eingetragen wurde, - Schäden an der Ausstattung bzw. Verlust der Ausstattung, welche in der Inventarliste eingetragen ist, falss sich diese nicht in einem abgeschlossenem Raum befand, - Schäden,die durch Dritte entstanden sind - Diebstahl bzw. Schaden an Gemälden und Edelmetallgegenständen, Geld- und Wertpapieren usw., die aus einem beliebigen Grund entstanden sind, - durch Schäden, die von auf dem Wasserfahrzeug befindlichen Nagetieren verursacht wurden, - Schäden, die durch Einfrieren oder Vereisung des Motorkühlsystems entstanden sind, - Schäden des Wasserfahrzeugs, die in der Zeit entstanden sind, in welcher sich der Schlüssel und Navigationsschein nicht an der Rezeption der Marina befanden, - Schäden durch unsachgemäße Anschlüsse von Strom- und Wasserinstallationen von der Pier bis zum Wasserfahrzeug - Schäden durch kaputte Seile, die dem Wasserfahrzeug gehören - Schäden durch Nichteinhaltung der Allgemeinen Bedingungen und Hafenregelen, - Schäden durch Nichtbeachtung der Zoll-, Hafen- und anderen Verwaltungsvorschriften, - Verlust der Fender, Seile, Anker, Propeller und anderer Ausstattung, die nicht entfernt werden kann, ohne aufgebrochen zu werden, - Schäden am Wasserfahrzeug, die durch ein anderes Wasserfahrzeug verursacht wurden, - Kosten der Wrackbeseitigung, - Schäden durch Verschmutzung, - Schäden an Fotoapparaten, Videokameras, Radios, Fernsehern und Ferngläsern, außer Schäden durch Versinken, Feuerbrand, Explosion, Diebstahl oder Verschwinden des Wasserfahrzeugs, zu welchen es durch Verschulden der Marina gekommen ist, - Schäden durch Feuer bzw. Explosion, wenn der Liegeplatzbenützer, Wasserfahrzeugeigentümer oder Dritte die Schutzmaßnahmen der Hafenregeln nicht beachtet hat, - alle anderen Schäden, für die die Marina vertragsgemäß nicht haftet. Artikel 12 Keine der Vertragsparteien trägt für die unordentliche Erfüllung des Vertrags die Verantwortlung, wenn dies durch höhere Gewalt verursacht wurde. Unter höherer Gewalt versteht man außerordentliche äußere Umstände, die nach Vertragsabschluss, jedoch vor Ablauf der Frist für die Erfüllung einer bestimmten Verpflichtung entstehen, deren Eintritt die Vertragsparteien nicht hätten vorhersehen, vermeiden bzw. abwehren können und eine der Vertragsparteien eine Erfüllung der Vertragsverpflichtung vereiteln, wie z.b. Orkanböen, außerordentliche Flutwelle, Erdbeben, Brand, Epidemie, andere Naturkatastrophen bzw. -unfälle, Regierungsmaßnahmen, Streik, Zivilunruhen, Krieg. Artikel 13 Der Vertrag endet, außer nach Beendigung der Vertragsdauer auch in folgenden Fällen: a) einvernehmliche Kündigung, b) einseitige Kündigung vor Vertragsablauf, wenn: - eine der Vertragsparteien die wesentlichen Voraussetzungen des Vertrags oder der Allgemeinen Bedingungen nicht einhält, wie z.b. Liegeplatzberechtigung und rechtzeitige Zahlung, - wegen höherer Gewalt eine der wesentlichen Verpflichtungen aus dem Vertrag oder den Allgemeinen Bedingungen nicht erfüllt werden kann, - der Liegeplatz durch höhere Gewalt zerstört wurde. In diesem Fall ist der Kunde auf die Rückerstattung des entsprechenden Anteils am Liegeplatzpreis für die restliche ungenützte Zeit bis zum Ablauf des Vertrags berechtigt. Jedoch kann die Marina von dieser Verpflichtung befreit werden, wenn sie dem Benützer einen anderen entsprechenden Liegeplatz anbietet und dieser ihn annimmt, - der Kunde bzw. der Eigentümer das Wasserfahrzeug verkauft. Die Vertragspartei, welche die Vertragskündigung zu verantworten hat, hat keinen Anspruch auf einseitige vorzeitige Beendigung des Vertrags. Die einseitige vorzeitige Beendigung des Vertrags erfolgt durch Erklärung der kündigenden Vertragspartei an die andere Vertragspartei, in welcher sie den Grund der Vertragsbeendigung anführt. Dies gilt nicht im Falle von Art. 1 Abs. 1 dieser Bedingungen. Die Vertragspartei, welche die Kündigung zu verantworten hat, haftet der anderen Vertragspartei für alle Schäden, die durch die Vertragskündigung verusacht wurde. Im Fall einvernehmliche oder einseitige Liegeplatz Vertragskündigung, ist die Marina nicht zur rückerstattung der einbezahlten Gelder verpflichtet.

18 Die Marina behält sich das Recht vor, nach dem Ablauf des Vertrags keinen neuen Vertrag abzuschließen bzw. den vorhandenen Vertrag nicht zu verlängern. Artikel 14 Die Vertragspartei verpflichtet sich, bevor sie das Wasserfahrzeug der Obhut und Wartung überlässt, eine Bestellung der Winterarbeiten auszufüllen. Artikel 15 Der Kunde hat kein Recht, den Liegeplatz auf die Dauer oder vorläufig an Dritte weiter zu vermieten bzw. ihnen die Benutzung desselben zu gewähren. Artikel 16 Während der Abwesenheit des Wasserfahrzeugs kann die Marina seinen Liegeplatz an einen anderen Benützer vermieten. Der Liegeplatzbenützer, Eigentümer des Wasserfahrzeugs bzw. ihre Bevollmächtigte, haben jede Abwesenheit anzumelden. Die Zeit der Abwesenheit aus der Marina wird nicht vom Liegeplatzentgelt abgezogen. Artikel 17 Es ist verboten, Zu Verkaufen - Schilder am Wasserfahrzeug anzubringen. Das Personal der Marina wird alle solchen Zeichen ohne vorherige Benachrichtigung entfernen. Der Eigentümer wird hiermit auf das Vermittlungsbüro hingewiesen. Artikel 18 Das Wasserfahrzeug kann von anderen Personen, die nicht Liegeplatzbenützer und Eigentümer des Wasserfahrzeugs sind, nur mit schriftlicher Erlaubnis des Liegeplatzbenützers bzw. Eigentümers benützt werden. Die Dienstleistung des Aufenthalts im Marinabereich wird laut gültiger Marinapreisliste verrechnet. Artikel 19 Die Arbeiten, welche über die vereinbarte Verpflichtung hinausgehen, die der Liegeplatzbenützer, Wasserfahrzeugeigentümer bzw. ihre Bevollmächtigten, ihre Besatzung und sonstigen (ausdrücklich ermächtigten) Personen an Bord bestellen, werden sofort nach der erfolgten Leistung und nach ausgestellter Rechnung fällig. Die bestellende Partei hat alle Beschwerden spätestens binnen 30 Tagen nach Erhalt der Rechnung anzumelden. Artikel 20 Servicereperaturen und Arbeiten am Wasserfahrzeug und Motor können nur innerhalb der Servicezone durchgeführt werden. Dritten ist die Arbeit nur mit Genehmigung der Marina gestattet. Im operativen Gebiet des Krans, Stapels und der übrigen Transportausstattung ist der Aufenthalt von nicht ermächtigten Personen verboten. Artikel 21 Der Liegeplatzbenützer bzw. der Eigentümer des Wasserfahrzeugs ist verpflichtet, für das Wasserfahrzeug und die Ausstattung eine Haftpflichtversicherung, inklusive für eventuelle Schäden, welche andere Wasserfahrzeuge oder die Marina erleiden abzuschließen. Nichtversicherte Wasserfahrzeuge werden nicht von der Marina aufgenommen, d.h. es wird keine Haftung für Schäden an einem solchen Wasserfahrzeug übernommen. Artikel 22 Die Marina behält sich das Recht vor, die Länge des Wasserfahrzeugs zu messen. Artikel 23 Die Marina haftet nicht für Schäden und andere Folgen, die auf Grund der Nichteinhaltung des Vertrags, dieser Allgemeinen Bedingungen und der Hafenregeln entstehen. Artikel 24 Diese Bedingungen tritt ab dem Tag des Erlassens in Kraft. Mit dem Tag des Anwendungsbeginns dieser Bedingungen endet die Gültigkeit der Allgemeinen Bedingungen für einen Abschluss des Liegeplatzvertrages vom 01. Jänner Murter, den 01. 19 MARINA HRAMINA HAFENREGELN Artikel 1 Bei der Ankunft in die Marina Hramina d.o.o. (nachstehend: Marina) sind alle Besucher verpflichtet, sich anzumelden und dabei ihren Reisepass bzw. Personalausweis vorzulegen. Artikel 2 Das Wasserfahrzeug, Rettungsboot, Anhänger und das Fahrzeug sind sichtbar mit dem Zeichen der Marina und dem Namen des Wasserfahrzeugs bzw. einer anderen durch die Marina bestimmten Markierung zu kennzeichnen. Artikel 3 Der Eigentümer hat sein Fahrzeug und den Anhänger nach den für den dafür bestimmten Raum gültigen Verkehrsregeln abzustellen; die Marina haftet nicht für Schäden an Fahrzeugen und Anhängern bzw. für ihren Diebstahl. Artikel 4 Rettungsboote, Surfboards, Satellitenantennen und andere Ausrüstung dürfen nicht auf der Pier bzw. im Meer installiert oder gehalten werden sondern nur dort, wo das vorgesehen ist. Artikel 5 Es ist verboten, die Ruhe anderer zu stören. Von Uhr abends bis 8.00 Uhr morgens ist es verboten, Lärm zu machen. Artikel 6 Während des Aufenthalts in der Marina ist der Gebrauch der Wasserfahrzeugtoilette verboten. Artikel 7 Der Kunde hat dafür zu sorgen, dass seine Seile und Fender der Navigation anderer Besucher nicht im Wege stehen. In der Marina sind keine Bojen zulässig. Artikel 8 Altöl, Erdöl oder mit Fett und Fäkalien verschmutztes Wasser, Fett- und Waschmittelreste oder Schiffsabfälle müssen in den dafür vorgesehenen Containern oder Geräte für die Hantierung und Aufnahme von festen und flüssigen Abfällen, gemäß den Bestimmungen der MARPOL - Konvention, entsorgt werden. Artikel 9 Innerhalb der Marina ist es verboten, Feuer zu machen bzw. Tätigkeiten auszuüben, die zum Feuer führen können. Artikel 10 In der Marina ist Gefährdung anderer durch Rasen oder rücksichtsloses Fahren nicht zulässig. Surfing oder Angeln ist im Kreis von 200 um die Marina verboten. Baden darf man nur an den dafür bestimmten Stellen. Artikel 11 Hunde dürfen in der Marina nicht ohne Leine frei umherlaufen. Artikel 12 Wartungsreparaturen und Arbeiten am Wasserfahrzeug und dem Motor dürfen nur innerhalb der Wartungszone vorgenommen werden. Unbefugten ist der Zutritt in der Reichweite des Krans, des Stapels und anderer Betriebsausrüstung untersagt. Die Arbeit Dritter ist nur mit Genehmigung der Marina gestattet.
