CONDIZIONI GENERALI DI VENDITA 1 - ORDINAZIONI a) Le ordinazioni e ogni altro accordo preso dai nostri agenti sono impegnative per il compratore ma non vincolanti per il venditore. b) Tutte le ordinazioni si intendono accettate alle presenti condizioni generali di vendita. c) Tutte le ordinazioni devono essere tassativamente fatte per iscritto e trasmesse via fax. d) I prezzi sono validi al momento della spedizione e si intendono IVA esclusa. e) I prezzi si intendono franco partenza. f) Gli ordini saranno evasi solo per confezioni complete. 2 - TEMPI DI CONSEGNA a) I tempi di consegna sono puramente indicativi, nessun ritardo nella consegna potrà mai, in ogni caso, dar diritto al cliente di chiedere indennizzi per danni o l annullamento dell ordine. b) Gli ordini con tempi di evasione superiore a 30 gg sono accettati con riserva di verifica prezzi. 3 - SPEDIZIONI Le spedizioni sono effettuate coi mezzi ritenuti più idonei, la merce viaggia a rischio e pericolo del Committente anche se venduta franco destino. Una volta firmata la bolla senza nessuna riserva la stessa si intende accettata e conforme. Tutte le riserve e i reclami inerenti alla merce dovranno essere fatti, pena la nullità, direttamente al trasportatore al ritiro merce ed entro 8 giorni a ERBA SRL. 4 - IMBALLI Gli imballi particolari saranno addebitati in fattura al prezzo di costo e non saranno accettati di ritorno. 5 - RESI I resi di materiale dovranno essere preventivamente autorizzati da ERBA SRL a condizione che si tratti di merce in imballo originale e integro e che i modelli siano ancora in commercio. 6 - PAGAMENTI In caso di ritardato pagamento decorreranno gli interessi commerciali nella misura del tasso ufficiale di sconto aumentato di tre punti più spese sostenute. 7 - MISURA, PESI E INFORMAZIONI ERBA SRL non assume responsabilità sulle misure, pesi e assoluta uniformità di colori riportati sulle documentazioni dei prodotti commerciali. Ogni indicazione al riguardo non ha carattere impegnativo ma semplicemente informativo. 8 - MODELLI ERBA SRL si riserva il diritto di cessare la commercializzazione, senza preavviso, di qualsiasi modello o di introdurre modelli con modifiche, senza per questo essere obbligata a effettuare tali modifiche sui prodotti precedentemente forniti. 9 - FORO COMPETENTE Per qualsiasi controversia è competente il Foro di Milano. I dati tecnici sono da considerarsi puramente indicativi e non impegnativi per la ditta.
