REGIONE SICILIANA ALBERGHI DI SICILIA 2005-2006 NORME DI APPLICAZIONE DELLE TARIFFE 13 Norme di applicazione delle tariffe Normes pour l application des tarifs Applicable conditions for prices I prezzi dei servizi alberghieri e delle altre strutture ricettive (ex Legge n. 217 del 17 maggio 1983 e Legge regionale n. 27 del 6 aprile 1996) sono liberamente determinati dai singoli operatori (Legge 25 agosto 1991 n. 284). Gli operatori comunicano i prezzi di pernottamento nelle strutture alberghiere ed i prezzi delle strutture ricettive ai fini della vidimazione e della pubblicità di cui al regio D. L. 24 ottobre 1935 n. 2049 convertito in Legge 26 marzo 1936 n. 526. Il presente annuario comprende gli esercizi alberghieri aperti entro il 1 marzo 2005 e i prezzi si riferiscono al periodo dal 1 marzo 2005 al 28 febbraio 2006. I prezzi riportati nella presente pubblicazione sono espressi in Euro. Il prezzo della camera non può essere nè superiore nè inferiore a quello indicato nell appposita tabella prezzi che deve essere esposta, in modo ben visibile al pubblico, nell ufficio di ricevimento degli ospiti e riportato nell apposito cartellino all interno di ogni camera e in ogni altro luogo di prestazione dei servizi. La consumazione della prima colazione, quando non è inclusa nel prezzo della camera, è facoltativa. La relativa tariffa, risultante dalla tabella prezzi esposta nel bureau, potrà essere addebbitata (separatamente dalla tariffa della camera) solo se tale prestazione sarà stata espressamente richiesta dal Cliente. Qualora una camera a due letti venga assegnata ad una persona sola e non sia stata espressamente richiesta dal Cliente, il prezzo non potrà superare quello massimo denunciato per le camere ad un letto (regio D. L. 244/37 circolare 08680/55). L accessibilità negli esercizi ricettivi per i disabili è regolata dal Decreto ministeriale (Ministero LL.PP.) 14 giugno 1989, n. 236. Il servizio telefonico, il cui costo d impianto è già considerato nella tariffa alberghiera, viene fornito ai clienti al solo costo di traffico più IVA, secondo le tariffe telefoniche in vigore per le comunicazioni a contatore o tramite prenotazione che possono essere rilevate dalla guida telefonica e che comunque vanno richieste all atto della prenotazione (Decreto ministeriale 8 maggio 1997 n. 197). La responsabilità dell albergatore per furti o danneggiamento di oggetti di proprietà dei clienti è prevista in apposite disposizioni di legge (Codice civile, articoli n. 1783-1784 - 1785/bis - 1785/ter - 1785/quater - 1785/quinquies - 1786). Il personale alberghiero è regolarmente retribuito dalle aziende ricettive per le sue normali prestazioni; pertanto le mance costituiscono una ricompensa facoltativa assolutamente spontanea e non devono formare oggetto di alcuna sollecitazione. L albergatore è obbligato a fornire al cliente una ricevuta fiscale per tutti i servizi prestati (soggiorno, pasti, bevande, ecc.). Richiedere tale documento è un dovere di ogni cittadino il quale, oltre ad assolvere ad un preciso obbligo di legge ed evitare sanzioni pecuniarie, si assicura la conoscenza dell esatto importo da pagare. I turisti che avessero da rilevare l applicazione di prezzi superiori a quelli pubblicati nel presente elenco, e non ottenessero sufficienti chiarimenti da parte dell albergatore, potranno presentare documentato reclamo entro 60 giorni all «Azienda Autonoma Provinciale per l Incremento Turistico». Les opérateurs communiquent les prix d hébergement dans les structures d accueil dans un but simplement publicitaire selon le D. L. 24.10.1935 n. 2049 converti par la L. 26.3.1936 n. 526. Ce guide comprend les établissements hôteliers ouverts avant le 1 march 2005 et les prix se rapportent à la période du 1 march 2005 au 28 février 2006. Les prix indiqués dans cette pubblication sont exprimés en Euro. Le prix de la chambre ne peut être supérieur ni inférieur à celui qui est mentionné sur le listing des prix qui doit être exposé de façon visible au public, dans le bureau d accueil et reporté sur la fiche disposée à l intérieur de chaque chambre et dans tout autre lieu de prestation de services. Le petit déjeneur (s il n est pas inclus dans le prix de la chambre) est facultatif. Le prix, affiché au bureau de l hôtel, ne pourra être débité (séparé du prix de la chambre) que si le Client demande expressément ce service. Dans le cas où une chambre à deux lits serait assignée à une seule personne et qu elle n aurait pas été explicitement demandée par le Client, le prix ne pourra être supérieur au prix spécifié pour les chambres à un lit (R. D. L. 244/37 circ. 08680/55). L accés aux établissements hôteliers, pour les personnes handicapées est reglé par le Decret Ministériel du 14 Juin 1989, n. 236. Le service du téléphone est fourni aux clients au prix courant, plus TVA, selon les tarifs téléphoniques en viguer pour les communications au compteur ou qui passent par le standard, tarifs qui figurent dans l annuaire du téléphone et qu il est opportun de se faire préciser quand on demande la communication (Decreto ministeriale 8 maggio 1997 n. 197). La responsabilité de l hôtelier, en cas de vol ou dommages causés aux objets et effets appartenant aux clients, est fixée par la loi (Code Civil, articles 1783-1784 - 1785-1785/bis - 1785/ter - 1785/quater - 1785/quinquies - 1786). Les employés de l hôtel sont dûment rétribués par leurs patrons; par conséquent les pourboires sont une compensation facultative et ne doivent en aucun cas être exigés. L hôtelier doit fournir au client une facture pour tous les services rendus (séjour, repas, boissons, etc.). Exiger ce document est le devoir de tout citoyen qui, outre respecter la loi et éviter une amende, prend connaissance du montant exact à payer. Les touristes, qui auraient constaté l application de prix supérieur à ceux qui sont indiqués sur le listing ci-joint et qui n auraient pas obtenu satisfaction de la part de l hôtelier, pourront presenter une réclamation détaillée à l «Azienda Provinciale per l Incremento Turistico». The operators communicate the cost of each overnight stay in the hotels and the price of any other sort of accomodation only as an advertising information according to R. D. The above can be checked on the telephone book, however rates shoud be requested when booking (Decreto ministeriale 8 maggio 1997 n. 197). Hotel keepers liability regarding theft or damage to clients personal property is defined by law (Civil Code, Arts: 1783-1784 -1785-1785/bis - 1785/ter - 1785/quater - 1785/quinquies - 1786. Members of the staff are regularly paid by the management for the ordinary duties; tips are therefore a spontaneous and voluntary recompense, at no time and in no way to be solicited. It is compulsory for hotel-keepers to give their clients an official receipt for all services rendered (room, meals, drinks, etc.). To demand such a receipt is a duty for all customers who, in this way, comply with strict legal requirementes, avoiding the possibility of heavy fines, and furthermore are informed of the exact amounts to be paid. Those tourists who find higher prices than those published on the list and who do not obtain sufficient satisfaction from the hotel management can present a documented complaint within 60 days to the «Azienda Provinciale per l Incremento Turistico». Die Preise der Hotels und der anderen Verpflegungsmöglichkeiten (ex Ges. 17/5/83 NR. 217 und L. R. 6.4.1996 NR. 27) sind von den einzelnen Gasthofbesitzern bestimmt (Ges. 25.8.1991 NR. 284). Die Hotelbesitzer teilen die Preisen der Hotels und der anderen Verpflegungsmöglichkeiten nur zum Zweck der Werbung nach dem königlich mit Dekret 24.10.1935 NR. 2049 BZW Ges. 26.3.1936 NR. 526. Das vorliegende Jahrbuch umfaßt nur die bis zum 1.3.2005 eröffneten Beherbergungsbetriebe und die Preise beziehen sich auf den Zeitraum 1.3.2005-28.2.2006. Die Preise in diesem Jahrbuch sind Euro. Der Preis des Zimmers kann weder billiger oder teuerer als der Preis auf der Tabelle geschriebene Preis. Diese Tabelle soll in der Reception, in jedem Zimmer und in jedem Raum, in dem Dienste geleistet werden, aufgestellt werden. Der Verzehr des Frühstücks bleibt, wemm es nicht im Zimmerpreis inbegriffen ist, dem Gast freigestellt. Der dafür gültige Preis geht aus der im Büro aufliegenden Liste hervor und kann (getrennt vom Zimmerpreis) nur verrechnet werden, wenn ausdrücklich Frühstück verlangt wurde. Falls ein Doppelbettzimmer für eine Person zugeteilt wird, dies jedoch vom Kunden nicht ausdruecklich verlangt wird, darf der Preis den fuer ein Eizelbettzimmer nicht ueberschreiten (R. D. L. 244/37 circ. 08680/55). Der Zugang für Behinderte in Hotels und Gasthäuser ist durch den Ministerialerlaß Nr. 236 vom 14.6.1989 geregelt (Min. LL.PP.). Der Telefondienst wird den Kunden, nur nach den Einheitskosten, zuzüglich MWST, jeweils nach dem gültigen Telefontarif angeboten. Die Einheitsgebühren, sei es für Gespräche durch Apparate mit Einheitszähler sowie durch Vermittlung können aus dem Telefonbuch entnommen werden, sollten aber auf jeden Fall bei der Gesprächsanmeldung nachgefragt werden (Decreto ministeriale 8 maggio 1997 n. 197). Die Haftung des Gastwirts für Diebstahl und Beschädigung des Eigentums eines Gastes ist durch das Gesetz geregeit (Zivilgesetzbuch Art. 1783-1784 - 1785/bis - 1785 ter -1785 quater/quinquies - 1786). Das Personal wird von der Hoteldirektion für seine gewöhnlichen Dienstleistungen entsprechend entlohnt. Jedes Trinkgeld steht im Belieben des Gastes; Trinkgeldforderungen sind unberechtigt. Der Hotelier ist verpflichtet, dem Kunden eine ordnungsgemäß ausgestellte Empfangbestätigung (ricevuta fiscale) für alle beglichenen Dienstleistungen (Aufenthalt, Speisen, Getränke, u.a.) auszuhändigen. Jeder Kunde hat nicht nur das Recht, sondern auch die Pflicht diesen Beleg zu verlangen. Dies ist angeraten sowohl um bei Nichteinhaltung dieser Pflicht Geldstrafen zu vermeiden, als auch um die genaue Höhe des nach Posten aufgegliederten Betrages zu kennen. Die Touristen, denen hörere Preise aufgerechnet werden als die in diesem Verzeichnis angegebenen, können sich, wenn sie von dem Hotelier nicht befriedigt werden, mit einer Beschwerde innerhalb 60 tagen an die «Azienda Autonoma Provinciale per l Incremento Turistico» wenden. Los prècios de los servìcios hoteleros y de otras estructùras de alojamiento (ex-ley n. 217 del 17 de Mayo 1983 y L. R. n. 27 del 6 de Abrìl 1996) son establecìdos libremente por cada emprèsa (Ley n. 284 del 25 de Agosto 1991). Las empresas comunìcan los preèios de alojamiento en las estructuras hoteleras y los prècios de otras estructùras con la sola finalidad de su difusión según el Real Decreto-Ley n. 2049 del 24 de Octubre 1935, convertìdo en Ley n. 526 del 26 de Marzo 1936. La presente Guìa comprende los hoteles abièrtos desde el 1 de Marzo 2005 y los prècios se refieren al periodo 1 de Marzo 2005-28 de Febrero 2006. Los prècios reproducidos en la presente pubblicación son expresados en Euro. El prècio de la habitación no puede ser ni superior ni inferior al indicado en la lista de prècios, que debe ser expuesta visiblemente al público en la oficìna de recepción de clientes y reproducida en cada habitación y en cualquièr otro lugar de prestación de servìcios. La consumición del desayuno, cuando no es incluido en el prècio de la habitacíon, es opcional. La tarìfa relativa, indicada en la lista de prècios expuesta en la recepción, podrá ser cargada en la cuenta (disociada del precio de la habitación) sólo en el caso de que dicho servìcio haya sido requerìdo expresamente por el cliente. En el caso que una habitación con dos camas sea asignada a una persona sola sin que haya sido requerida expresamente por el cliente, su prècio no podrá superar el precio máximo indicado para habitaciones con una cama (R.D. L. 244/37 circ. 08680/55). La accesibilidad en los hoteles para los impedidos es regulada por el Decreto Ministeriale (Min. LL.PP.) 14 de Junio 1989, n. 236. El servìcio telefónico es ofrecìdo a los clientes al solo coste de tráfico más IVA, segùn las tarìfas telefónicas vigentes para las comunicaciones con contador o trámite reserva que pueden ser relevadas de la guìa telefónica y que de todos modos tienen que ser pedidas al momento de la reserva (Decreto Ministeriale 8 de Mayo 1997 n. 197). La responsabilidad del hotelero por robo o daños de objetos de propriedad de los clientes está prevista en leyes, especiales (Còdigo Civil, art. 1783-1784 - 1785-1785/bis- 1785/ter - 1785/quater - 1785/quinquies- 1786). El personal de los hoteles es retribuido regularmente por la Direcciòn de hotel por sus prestaciones normales. Las propìnas constitùyen una recompensa facultativa, absolutamente espontànea y por consiguiente el personal no debe pedìrlas al cliente. El hotelero está obligado a proveer al cliente de un recìbo fiscàl por todos los servìcios prestàdos (alojamiento, comìdas, bebìdas, etc.). Solicitar tal documento es deber de todo ciudadano que, además de cumplir con una concreta norma legal y evitar sanciones pecuniarias, se asegura conocer el importe exàcto a pagar. Los turìstas que encontraràn una aplicación de prècios superior a los publicados en la lista adjunta, y no obtuvièran una respuèsta satisfactoria por parte de la dirección hotelera, podrán presentàr una reclamación documentada dentro de 60 días a la «Azienda Auton. Provinciale per l Incremento Turistico».
