2 CONDIZIONI GENERALI DI VENDITA PER LA FORNITURA DI PRODOTTI FERROALLUMINIO VALIDITA Gli ordini devono essere trasmessi per iscritto e confermati da noi. La consegna di quanto richiesto è subordinata alla restituzione di copia della nostra conferma d ordine fi mata per accettazione di prezzi, sconti e termini di pagamento, nonché delle condizioni generali di vendita che regolano le nostre vendite. TRASPORTO La merce viaggia sempre a rischio e pericolo del COMPRATORE anche se venduta franco destino. RESA Per ordinativi di valore totale inferiore a (IVA esclusa), la merce si intende sempre spedita in porto assegnato. TERMINI DI CONSEGNA I termini di consegna si intendono indicativi. Qualsiasi caso di forza maggiore che impedisca o limiti il normale andamento della produzione autorizzerà alla sospensione dei contratti. Eventuali ritardi non daranno in ogni caso diritto al Compratore di recedere dal contratto o di ottenere indennità di alcuna specie. La consegna si intende avvenuta quando la merce viene messa a disposizione per il trasporto. RECLAMI E RITORNI Le quantità indicate in bolla dovranno essere controllate all atto del ricevimento. Eventuali differenze dovranno essere segnalate al vettore e riportate sulla bolla di consegna. Nessun reclamo relativo alla consegna potrà essere elevato decorsi otto giorni dal ricevimento della merce. Eventuali ritorni devono essere da noi preventivamente autorizzati e spediti in porto franco. PAGAMENTI Il pagamento delle fatture dovrà essere effettuato secondo le modalità convenute ed indicate sulle nostre conferme d ordine. Ogni ritardo di pagamento, indipendentemente dalle sue cause, comporterà l addebito dei relativi interessi bancari al tasso corrente applicato sullo scoperto di c/c. FORO CONVENZIONALE Per qualsiasi controversia è competente il foro di Trieste. Il presente listino annulla e sostituisce quelli precedentemente distribuiti. Le quotazioni in esso indicate si intendono per un numero di non inferiore alla confezione minima. La Ferro Alluminio si riserva di variare senza preavviso le caratteristiche degli articoli qui elencati allo scopo di adeguarli a future esigenze tecniche e commerciali. Alcuni accessori portano nella codifica lettere XX che nell ordine dovranno essere sostituite con i seguenti codici: GENERAL SALE CONDITIONS FOR THE SUPPLY OF FERROALLUMINIO PRODUCTS VALIDITY Orders have to pass in writing and confi med by us. The delivery of goods ordered is dependant on the return of the copy of our order confi mation form duly signed in acceptance of our s, discounts, form of payment indicated as well as the general sales conditions that regulate our sales. TRANSPORT The goods always travel at the buyer s risk even if the supplier is responsible for the transport costs. RESTITUTION For orders of total value less than (excluding VAT) it is understood that the goods be returned at the carriage forward. TERMS OF DELIVERY Delivery terms are understood to be approximate. Any situations involving circumstances beyond our control that hinder or limit our normal production will authorize the suspension of the contracts. In any case eventual delays will not give the buyer right to withdraw from the contract or to obtain indemnity of any sort. The delivery is understood to mean that goods are ready for transport. COMPLAINTS AND RESTITUTION The quantity indicated on the bill must be checked on receiving the goods. Eventual differences must be pointed out to the carrier and noted on the delivery invoice. No complaint relating to the delivery may be accepted more than eight days alter receiving the goods. Eventual goods returned must be authorized by us and despached carriage paid. PAYMENT The payment of the invoice must be made according to the conditions as agreed and indicated on our order confi mation. Any delay in payment, independant from its cause, will lead to the application of related bank interest at current rate to be added to the amount owing. COURT RESPONSIBLE IN CASE OF DISPUTE For any dispute the competent authorithy is the Court of Trieste. This list cancels and substitutes any previously distributed. The quotes indicated in it are understood to be for a number of articles no less than the minimum pack. Ferroalluminio reserves the right to vary without notice the characteristics of the articles herein listed with the scope of adapting them to future technical and commercial requirements.
