1 Consolato d Italia NEWARK INFORMAZIONI GENERALI PER LA CITTADINANZA La cittadinanza italiana si basa sul principio dello ius sanguinis (diritto di sangue), per il quale il figlio nato da padre italiano o da madre italiana è italiano; tuttavia è da tener presente che la madre cittadina trasmette la cittadinanza ai figli minori solo a partire dal , per effetto di una specifica sentenza della Corte Costituzionale. MODALITA' DI ACQUISIZIONE DELLA CITTADINANZA ITALIANA Si elencano qui di seguito le piu' comuni modalita' di acquisizione: 1) Per filiazione; 2) Per nascita sul territorio italiano, solo ed esclusivamente quando i genitori siano ignoti o apolidi o non trasmettano la propria cittadinanza al figlio secondo la legge dello Stato al quale essi appartengono; Se lo straniero è nato sul territorio italiano può ottenere la cittadinanza se risiede legalmente ed ininterrottamente in Italia dalla nascita fino al raggiungimento della maggiore età; 3) Per adozione; 4) Per matrimonio con cittadino\a italiano\a Il coniuge straniero di cittadino italiano che desideri acquistare la cittadinanza in base all Art 5 legge 91/1992 puo presentare istanza: - se residente in Italia: alla Prefettura competente, 24 mesi dopo la celebrazione del matrimonio; - se residente all estero: all autorita consolare territorialmente competente, dopo tre anni dalla celebrazione del matrimonio. Requisito formale per la presentazione dell istanza e che il matrimonio, se celebrato all estero, sia stato trascritto presso un Comune italiano. 2 Gli interessati - residenti in questa circoscrizione consolare e il cui matrimonio e stato gia trascritto in Italia - possono richiedere per lettera, o fax, le linee guida redatte in materia da questo Consolato. 5) Per naturalizzazione: Poiche' il requisito e' la residenza in Italia le relative istanze vanno richieste alla prefettura competente. DISCENDENTI DI CITTADINI ITALIANI: La legislazione italiana prevede la possibilita che la cittadinanza italiana sia riconosciuta ai discendenti di seconda generazione e oltre, di nostri emigrati. Il riconoscimento del possesso dello status civitatis italiano e subordinato a determinate condizioni e al documentato accertamento di alcune essenziali circostanze, la piu importante delle quali e stabilire se e quando l antenato di prima emigrazione negli USA si e naturalizzato cittadino americano. Infatti se la naturalizzazione dell avo ha avuto luogo DOPO la nascita del figlio (o figlia) dal quale il richiedente discende in linea diretta, il richiedente potrebbe aver diritto al riconoscimento della cittadinanza italiana. Si fa presente che il riconoscimento della cittadinanza in linea materna puo essere problematico in quanto la donna trasmette la cittadinanza italiana solo a figli nati dopo il IMPORTANTE - Acquisto della cittadinanza americana (o altra straniera) da parte di cittadini italiani L acquisto di una cittadinanza straniera avvenuto successivamente al 15 agosto 1992 non comporta la perdita della cittadinanza italiana. Coloro invece che hanno acquistato una cittadinanza straniera prima del 15 agosto 1992, hanno perduto automaticamente quella italiana. Costoro possono riacquistare la cittadinanza italiana trasferendo la propria residenza in un Comune italiano (art.13 legge 91/1992): anche in questo caso gli interessati sono invitati a consultare le relative istruzioni.

6 Consolato d Italia NEWARK ITALIAN CITIZENSHIP: GENERAL INFORMATION Italian citizenship is based on the principle of iure sanguinis (blood right) by which a child born of an Italian father or mother is Italian. Nevertheless, it must be kept in mind that the mother citizen has only transmitted citizenship to minor children since January 1st 1948, as a result of a ruling by the Constitutional Court. WAYS TO BECOME AN ITALIAN CITIZEN Here below some of the most common ways to obtain Italian Citizenship: 1. By having an Italian ancestors; 2. By being born in Italy, but only on condition that parents are unknown, stateless or do not transmit their own citizenship to their child according to the legislation of the State to which they belong; 3. By adoption; 4. By marriage to an Italian citizen: The foreign spouse of an Italian citizen can apply for citizenship through the competent "Prefettura in Italy. If the couple resides abroad, the request should be submitted through the competent Italian Consulate after three years of marriage. Important: the marriage if celebrated abroad must have been registered in the Italian Municipality of origin of the Italian spouse. In order to obtain information on the exact procedure to be followed, you can request the relevant guide lines by writing a fax, or or a letter to this Consulate. 5. By naturalization: Since this process requires that the applicant be resident in Italy, the relevant instructions should be obtained at the competent Prefettura. ANCESTORS Italian citizenship can be recognized by birth through the paternal line (with no limit on the number of generations) or through the maternal line for individuals born after January 1, 1948.

7 Unlike U.S. citizenship laws, applicants are not automatically entitled to the Italian citizenship on the basis of being born in Italy. However, it is likely that one may be entitled to Italian citizenship if he or she were born in the U.S. and one of the parents (or grand parents ) was still Italian at the time of their birth (or their father s birth). To determine the eligibility, it is very important to find out whether the first ancestor who emigrated from Italy to USA naturalized as a US citizen or not and, in case he/she did, the exact date of naturalization is required. If the ancestor never naturalized as a US citizen, the Italian citizenship is passed on to the descendants. Similarly, if the ancestor s naturalization occurred after the birth of his son/daughter, the Italian citizenship is passed on to the child born in the USA and so on. You may request the guide lines by writing a fax, or or a letter to this Consulate, explaining the reasons of your request and attaching a summary of your ancestors basic bio-data (p.o.b., d.o.b., place and date of marriage, place and date of death, date of US naturalization) according to this SCHEME. The aid information is NECESSARY to verify the applicant's eligibility. This office will send the guide lines only to applicants whose eligibility has been verified. REINSTATEMENT OF CITIZENSHIP Those Italian citizens who became U.S. citizens prior to August 15, 1992 lost their Italian citizenship. Italian citizenship may be re-acquired through the following procedures set by article 13 of Law 91/1992 : transfer of residency in Italy (preferably if in the applicant s town of origin) and, after one year, Italian citizenship will be automatically reinstated (article 13, point D, law 91/1992). transfer your residency in Italy (preferably if in the applicant s town of origin) and, after being registered at the local Municipality as foreign resident, it is possible to apply for citizenship at the Citizenship Office of the Municipality (according to art.13, point C, law 91/1992). In alternative to point 2), it is also possible to sign a declaration at this Consulate (after submitting the naturalization, birth and marriage certificates): within one year from the date of said declaration the applicant must transfer his or her residency in an Italian Municipality, where the process will be as described in point 2). The declaration may be signed in this Consulate prior appointment. DUAL CITIZENSHIP The Italian citizens who became U.S. citizens after August 15, 1992 retained their Italian citizenship. They are kindly invited to communicate the date of the naturalization to this Consulate, for record purposes.
