8 Rancho del Seis Environmental / Wetland Information The following was submitted to USFWS and Army Corps of Engineers. The direct acreage impacts due to the intended mapping and development of the property impact Marsh Seasonal Wetland Vernal Pool wetlands subtotal There is also acre of direct impacts to waters of the U.S. (i.e. Laguna Creek) Of a total of acres of wetlands and other waters of the U.S. on the Rancho del Seis property, (over 93%) will be completely avoided by the proposed project. Of the acres of wetlands, acres (91%) will be completely avoided. (Open Space) Of the acres of other waters of the U.S., acres (99.9%) will be completely avoided. (Open Space). The Open Space area is the Upper Laguna Creek Drainage Improvement and Trail System area of the subject property that is desired by Sacramento County and Southgate Park & Recreation. The wetland consultant (Bruce Barnett) proposed to USFWS to restore wetland and aquatic acres on site and to purchase credits for acre of vernal pools and acre of seasonal wetlands, subject to terms of the Section 7 consultation with the USFWS. Those requirements as outlined in a December 22, 2009 USFWS letter were to purchase 3.21 acres (0.372 acre 2:1 = & 2:1 = 2.466) of vernal pool preservation credits and vernal pool creation credits. The FWS Biological Opinion was submitted to the Corps, but the application was not processed to the point of obtaining a 401 Water Quality certification from the Water Board, so the Corps shelved the 404 permit and did not complete the permit processing or the mitigation negotiations. Crustacean surveys were never done (wet and dry season sampling) - it could potentially reduce the mitigation ratio from 3:1 to 1:1.
