Assurance of Support Alcuni migranti dovranno ottenere una Assurance of Support (AoS) prima che possa essere loro rilasciato il permesso di soggiorno per vivere in Australia. Il Department of Immigration and Citizenship stabilirà quali domande di soggiorno necessitino di una AoS e il stabilirà il soggetto che può fungere da assurer. Qualora si riceva una richiesta di agire in veste di assurer, le informazioni del caso saranno reperibili presso i nostri uffici, dove tutti i potenziali assurer dovranno sostenere un colloquio. Qualora un soggetto sia arrivato in Australia grazie ad una AoS, l assurer avrà l'obbligo di mantenimento, durante il soggiorno in Australia, per un periodo compreso tra due e 10 anni, a seconda del tipo di permesso. I soggetti interessati e i rispettivi familiari a carico non potranno, in linea generale, presentare domanda di versamenti Centrelink mentre sono sotto tutela di un accordo AoS. Che cosa è una Assurance of Support? Una AoS è un accordo avente validità giuridica tra un residente o ente australiano (l assurer) e l Australian Government. L assurer si impegna al mantenimento del migrante (l assuree), in modo tale che quest ultimo non debba fare affidamento sui versamenti Centrelink. L assurer si impegna inoltre a rimborsare gli eventuali versamenti pubblici erogati all assuree durante il periodo di validità dell AoS. In base all accordo, il mantenimento degli eventuali figli dell assuree potrà essere inoltre rimborsabile (v. sotto). I nostri uffici stabiliranno l idoneità dell assurer a svolgere tale ruolo valutandone la disponibilità finanziaria per provvedere al mantenimento. Prima di presentare domanda in qualità di assurer, occorrerà valutare la propria capacità di fare fronte agli obblighi di legge e finanziari che l AoS implica. Periodo di copertura Una AoS può avere una validità compresa tra due e 10 anni, a seconda del tipo di permesso di soggiorno rilasciato. Se l assuree si trova in Australia, l AoS acquisterà efficacia a partire dalla data di rilascio del nuovo permesso di soggiorno; se l assuree non si trova in Australia, l AoS acquisterà efficacia a partire dalla data in cui l assuree arriva in Australia. L AoS avrà validità per l intero periodo anche in caso di interruzione del rapporto tra l'assurer e l assuree. Rimborso dei versamenti I nostri uffici potranno provvedere al mantenimento dell assuree durante il periodo di validità dell AoS nel caso in cui l assurer ne sia impossibilitato o l accettazione di tale mantenimento non sia ragionevole per l assuree. I versamenti rimborsabili erogati all assuree dovranno essere rimborsati ai nostri uffici dall assurer e comprendono: Austudy Payment Newstart Allowance Parenting Payment (Partnered) Parenting Payment (Single) Sickness Allowance Special Benefit Widow Allowance Youth Allowance. I versamenti aggiuntivi quali Rent Assistance e Crisis Payment potranno essere altresì rimborsabili. Garanzie bancarie Alcuni accordi AoS richiedono una fidejussione rilasciata dalla Commonwealth Bank of Australia. L operazione di cui sopra sarà necessaria qualora l assurer sia un ente o nel caso in cui le norme in materia di migrazione lo prevedano. L assurer dovrà presentare un deposito vincolato per l'importo della fidejussione. Non dovrà essere data alcuna disposizione fidejussoria fino a quando ciò non venga richiesto dai nostri uffici. La fidejussione potrà essere utilizzata per i debiti prodottisi in ragione delle erogazioni rimborsabili, nel periodo di validità dell AoS. Qualora la fidejussione non copra l importo totale, verrà fatto ricorso ai poteri in ambito di recupero crediti (ai sensi del Social Security Act 1991) al fine di recuperare il saldo dovuto dall assurer. Tali poteri potranno prevedere l avvio di un azione legale. A quanto corrisponde l importo fidejussorio? Per una AoS della validità di due anni, la fidejussione ammonterà a $5.000 per un adulto e $7.000 per due adulti in possesso del medesimo permesso di soggiorno. Per una AoS della validità di dieci anni, l importo ammonterà a $10.000 per un adulto e $14.000 per due adulti in possesso del medesimo permesso di soggiorno. Nel caso in cui l assurer sia un ente, la fidejussione sarà pari a $10.000 per una AoS della durata di due anni e a $20.000 per una AoS della durata di 10 anni, a prescindere dal fatto che i soggetti adulti coperti dalla assurance siano uno o due. Assurance of Support Some migrants need to get an Assurance of Support (AoS) before their visa to live in Australia can be granted. The Department of Immigration and Citizenship determines which visa applications need an AoS and the decides who can be an assurer. If you have been asked to become an assurer, we can assist you with information. All potential assurers need to have an interview with us. If you arrived in Australia under an AoS, it means your assurer is required to support you in Australia for two or 10 years, depending on your visa type. Generally, you and your dependants cannot claim Centrelink payments while covered by an AoS agreement. What is an Assurance of Support? An AoS is a legal agreement between an Australian resident or organisation (the assurer) and the Australian Government. The assurer agrees to support the migrant (the assuree), so they don t have to rely on Centrelink payments. The assurer also agrees to repay any recoverable government payments paid to the assuree during the AoS period. Support for any children of the assuree may also be recoverable under the agreement (see below). We decide who can be an assurer by assessing the assurer s financial capacity to provide support. Before applying to become an assurer, you should consider whether you are able to meet the legal and financial obligations of providing an AoS. Period of coverage An AoS can be for a period of two or 10 years, depending on the type of visa granted. If the assuree is in Australia, the AoS will start from the date the new visa is granted. If the assuree is not in Australia, the AoS will start from the date the assuree arrives in Australia. The AoS remains in force for the full period even if there is a breakdown in the relationship between the assurer and the assuree. Recoverable payments We may provide financial support to an assuree during the period of an AoS if the assurer cannot provide support or it s unreasonable for the assuree to accept support. Before doing this, we ll usually speak to both the assurer and assuree. Recoverable payments made to the assuree must be repaid to us by the assurer. These include: Austudy Payment Newstart Allowance Parenting Payment (Partnered) Parenting Payment (Single) Sickness Allowance Special Benefit Widow Allowance Youth Allowance. Bank guarantees Some AoS agreements require a bank guarantee issued by the Commonwealth Bank of Australia. This is necessary if the assurer is an organisation or when security is required by the migration rules. The assurer will need to lodge a term deposit for the amount of the bank guarantee. You must not arrange the bank guarantee until requested to do so by us. The bank guarantee may be used for debts caused by recoverable payments during the AoS period. If the bank guarantee doesn t cover the total amount, we ll use our debt recovery powers (under the Social Security Act 1991) to recover the balance from the assurer. This may include taking court action. How much is the bank guarantee? For a two year AoS, the bank guarantee amount is $5000 for one adult and $7000 where there are two adults on the same visa application. For a ten year AoS, the amount is $10 000 for one adult and $14 000 if there are two adults on the same visa application. Where the assurer is an organisation, the bank guarantee is $10 000 for a two year AoS and $20 000 for a 10 year AoS, regardless of whether there are one or two adults covered by the assurance.
